Law prohibiting violence against pregnant women approved

Deputies of the Legislative Assembly approved Tuesday bill No. 21.062 that seeks to protect pregnant women before, during and after childbirth and thus eradicate obstetric violence.

According to the deputies, pregnancies are adequately treated by hospitals and public and private clinics. However, in some occasions, the pregnant woman suffers what they called obstetric violence.

In addition, the Ombudsman's Office has conducted several investigations related to violations of the rights of pregnant women, which constitute forms of obstetric violence.

"For many Costa Rican women, obstetrics services are a real luxury, and they must suffer many hardships and unacceptable difficulties in this society," said Deputy Aida Montiel in its statement. "But there are other forms of violence that manifest, such as inappropriate and disrespectful treatment, not helping postpartum affection with the baby, not receiving timely and personalized attention and lack of information, among others."

According to data from the Survey of Women, Children and Adolescents of 2018, 94% of births in Costa Rica were treated in Social Security hospitals. In addition, the survey indicates that 58% of women who had a baby, suffered some level of obstetric violence.

According to the survey, the obstetric violence received by women were such as:

- 35% of women were not advised to apply specific procedures or give them medication.

- 19% did not give understandable explanations about the birth situation.

- 12% received shouts from hospital workers.

- 10% received rude comments.

- 9% did not have the necessary and adequate support during labor.

- 2% were physically attacked inside the hospital.

These figures show a reality that can be present every day in the hospitals and clinics, which is why it is imperative to improve the conditions of women and their babies, deputies said.

According to the new law, every pregnant woman has the right to receive comprehensive, clear and specific information about the different treatments, diagnoses, prognoses or surgical interventions.

An example of receiving timely information is when the specialist raises the possibility of a C-section versus natural childbirth delivery.

The law has the goal of guaranteeing the protection of pregnant women before, during and after childbirth, through comprehensive medical and administrative care and timely and respectful of their condition, said lawmakers.

This includes giving birth to a healthy baby in a clinically and psychologically safe environment, and having continuous practical and emotional support. "That means, being accompanied at the birth delivery process and being assisted by the friendly and helpful staff with adequate technical skills," said the deputies.
