Trial of Canadian citizen continues

The trial against a Canadian citizen of Lebanese nationality, surnamed Akl, is continuing in the Pavas Court. The case is being presided over by Judge Mauricio Jiménez.

Akl is accused of four crimes: extortion, attempted homicide, threats and deprivation of liberty. An individual is considered to be deprived of liberty if they are both 'under continuous supervision and control and not free to leave' according to the courts.

The court case includes two more suspects surnamed Farnandez and Pinnoch who, according to the prosecutor, were part of a criminal organization with Akl.

Akl was sentenced to precautionary measures in June and must remain in preventative detention throughout the trial process.

The other suspects, Fernandez and Pinnoch, remain at limited liberty and must not leave the country, speak to witnesses or other persons involved in the trial, and sign in monthly.

According to the prosecutor case, the three suspects are part of a alleged criminal organization dedicated to giving money loans to people in great need who were unable to obtain legitimate financing.

According to the investigation, the suspects took their clients to a gym in Escazú owned by Akl and his brother.

The suspects are accused of granting illegal loans, which involved a fee and high interest,  and then threatening, beating or depriving the clients of liberty when they did not make repayment.

According to one of the witnesses, whose identity is protected, he lost his job in December 2016 and accepted the terms of the loan. When he fell a few days behind in his repayments he was intercepted him in San Francisco de Dos Ríos by several individuals who took him to a gym allegedly owned by the Akl brothers in Escazú where they put a gun to his head.

The investigators report that several people had the same experience and are now witness.

These alleged events occurred between the years 2016 and 2017.

According to the investigation report, the criminal organization was detected in May 2017, as consequence of the murder of one of the Akl brothers, at the entrance of a school in Escazú,

Apparently, that man was attacked by two or more gunmen who were waiting for him at the entrance of the institution. The Judicial Investigation Organization started with the investigation of the murder and the facts surrounding Akl’s business.

Hours after the murder, his brother  was arrested at the Juan Santamaría Airport in Alajuela, as he was trying to leave the country.

Alejandra Araya, a lawyer for Akl, had reached an agreement with the Public Ministry in June. At that time, Akl agreed to accept the charges and undergo an abbreviated legal process that would sentence him to 23 years in prison.

That abbreviated process was not, however, accepted by the court which determined that a trial should be conducted in the Pavaz Court.

According to the prosecutor's expectations, the process is scheduled to end in the second week of November.

Officials at the Judicial Investigation Organization have stated that the investigation into the murder of Elias continues, but no suspects have been accused.



Paranormal Halloween Tales

A.M. Costa Rica is marking Halloween by publishing a selection of short stories written by readers. The title is "Spooky Costa Rica."

The stories were among those submitted in last year's Halloween short story contest.

The stories range from the humorous to horror, all with Costa Rican themes and places, such as the infamous Sanatorium Durán near Cartago.

Some of the readers are no stranger to publishing. A few have an extensive record of successful authorship.

Included in the selection is “The Witching Hour” by Albert A. Correia, which judges selected as the 2017 winning entry. Correia has an extensive list of books he has written.

“The Witching Hour” chronicles a strange Halloween party in Barrio Amón, complete with Costa Rican jungle animals.

Lisa Kolber, who writes under the name of Elle Brookes, presents the horror tale of a photographer who was consumed by the Sanatorio Durán. This is one of several stories of haunted places.

A bonus is an A.M. Costa Rica story that explores the creepy goings on in a northwest barrio of San José.

The book will be available today HERE online at Smashwords, an Ebook publishing service.

Dispute over marchamo rates

The president of the National Institute of Insurance, Elián Villegas, presented a complaint in the Contentious Administrative Court on Tuesday. Villegas wanted to get the approval to maintain the same rates as last year for the yearly obligatory insurance of vehicles and motorcycles known as marchamo.

According to Villegas, "the institute does not need to increase insurance rates, but the route chosen by the General Insurance Superintendence is to impose an increase in the yearly obligatory rate." For that reason, the president of the institute opted to present a formal claim to get the authorization to obviate the new rate imposed by the Superintendency.

"In defense of the owners of vehicles and mainly the owners of motorcycles, we have filed a precautionary measure before the court to ask the judges to proceed to give us enough guardianship to be able to charge the same as last year's rates, which is the same approved for the year 2019," added Villegas.

The General Superintendency of Insurance is the entity responsible for the authorization, regulation and supervision of individuals, natural or legal, involved in acts or contracts related to the insurance, reinsurance, public offering and insurance business. It is the organization that ultimately decides the mandatory insurance rates for all vehicles in the country.

The obligatory insurance of vehicles is an amount composed of several items that are divided among various institutions, which include the Finance Ministry, the National Insurance Institute, the Road Safety Council and the Environment Ministry.

According to the National Insurance Institute, marchamo is collected between November 1 and December 31. However, since the court may take several days to respond, it is possible that there will be a delay in the starting date. The amount to be paid cannot be estimated until the complaint is resolved.

"The institute does not need to increase insurance rates", said the organization president Villegas.


 

The Superintendent of Insurance, Tomás Soley, explained the reasons why the request to hold the cost of marchamo to last year’s rate was rejected, saying, "The estimate of the National Insurance Institute was not technically justified, nor does it show good administration of the plan."

According to the Superintendency, the Insurance Institute can file an appeal for revocation or an appeal with the National Supervisory Board of the Financial System within a period of 3 business days. With this appeal, the case of both rates (the one requested by the Institute and the one imposed by the Superintendency) will be reviewed.

Due to the legal situation, neither the date of payment nor the amount of payment has been specified.

Costa Rica will present at American Film Market

American Film Market starts today and is the largest film industry business event in the world. Costa Rica will be at the event and present 6 productions.

A delegation composed of two representatives of universities, six producers and entrepreneurs together with the Film Commission of the country will participate in the American Film Market, from October 31 to November 7 in Santa Monica, California, United States with the aim of promoting the audiovisual industry of Costa Rica.

The American Film Market is the largest film industry business event in the world. More than 7,000 industry leaders participate in the search for agreements, projections, conferences and networks.

Organizers stated that, in preparation for the American Film Market, producers and entrepreneurs attended the training of the Costa Rican Foreign Trade Promoter called "Creating Exporters Orange Economy," in which they received recommendations on how to establish negotiations, intellectual property, costs, etc.

Participants come from more than 80 countries and include acquisition and development executives, agents, lawyers, directors, distributors, festival directors, financiers, film commissioners, producers, writers, the global press and all those who provide services to the cinematographic industry.

For José Castro, Film Commissioner of Costa Rica, "This is an opportunity for Costa Rican professionals and entrepreneurs to develop their skills, to show and sell their finished and developing projects to potential buyers, investors, content sales agents or directly. In addition, distributors can seek co-production alliances to complete their projects. Undoubtedly, the American Film Market is a very important showcase for the film industry in the country."

Volunteers assist with graduation tests

The Public Education Ministry has begun administering the final exams for high school students, knows as the Bachelor tests.

Since the majority of teachers and administrative employees of the Ministry continue striking, Minister Edgar Mora made a call to the public for help during test week.  

According to the Ministry, "2,682 volunteers were chosen to be divided among 601 schools, to help with the care of young people during the final tests."

Among the people who response to the call are retired teachers, bachelor graduates of previous years, athletes, singers, musicians, politicians and even a winner of the Nobel Peace Prize.

The two-time president and winner of the Nobel Peace Prize, Óscar Arias, signed up as a volunteer to help students with the Spanish test this Tuesday at the Luis Dobles School in Sabana.

"The young people have suffered a lot with this strike, they have lost many classes, they need to win the bachelor degree, and I want to help," said Arias.

Regarding the strike, the former president said "this strike has unfortunately taken a lot of time, it is an injustice fundamentally for our youth people, and for their parents." The former president concluded his statement saying, "young people are the most valuable asset in a society."

Luis Paulino Siles, soccer referee and civil engineer, was one of those who came to help at Liceo de Costa Rica. "It's a great honor to be able to help. This allows us, those who have already lived, to make an approach to young people to fight continuously and achieve their goals. I believe in Costa Rica and I believe in young people, it is a way to make Costa Rica walk along good routes,” Siles said.

Among other public figures who signed up as volunteer to help the young people in their exams are: Paola Vega deputy, Eduardo Ulibarri, journalist, Mary Luisa Ávila, former Minister of Health; Carlos Roverssi, journalist and former Chancellor; Gabriela Traña, athlete; Pedro Capmany, singer; Alicia Vargas, former education minister.

According to the ministry, the volunteers were sent a text message with the dates, time and place in which they had to present themselves last Friday.

Telephone calls were also made to coordinate their presence in more than 600 schools in the country and they were assigned tasks such as supervising the process as citizens, verifying that everything remains in order and stimulating a quiet environment for the examination.

Edgar Mora, Education Minister, gave thanks to the volunteers. "We must dedicate ourselves to generate an emotional atmosphere, favorable for all students, encouraging them to go to do the exam. The presence of all these volunteers is significant, it means the support of the Costa Rican community to its students at a peak moment on their student careers."

According to the bachelor test schedule, there are still five more exams

• Today October 31 - Mathematics
• November 1 - Social Studies
• November 2 - Science (Biology-Physics-Chemistry)
• November 5 - Language (English-French)
• November 6 - Civics

These tests are vital for students to recover points lost in the third quarter, due to the lack of teachers in the classrooms.

As for the employees and teachers who are still on strike, the ministry confirmed that 556 teachers were reported to be on strike but were detected when they left the country between between September 9 and October 15th. For that reason, the ministry will open an investigation to the teachers who traveled during the period because they were supposedly in the streets supporting the strike. "We are in the process of an investigation where each one will be notified about the investigation that is being carried out,” while other cases are being opened, the ministry confirmed.

The strike of teachers and that of employees in other ministries employees was declared illegal by the Labor Court of San Jose. However, "the education sector represents 98.55 percent of the people who continue on strike," confirmed the ministry.

Lance Armstrong will compete in Costa Rica bicycle race

Professional cyclist Lance Armstrong would arrive in the country today to participate in the 2018 edition of Costa Rica’s Route of the Conquerors.

The American cyclist will record his journey in the Costa Rican competition to produce a documentary.

Román Urbina, founder of the competition, stated that "Lance arrives the day before and leaves the day after the competition. These images of Lance in our country will serve us well in the future. He comes with this specialized group to follow him in his adventure, as he himself will record his journey."

According to the organizers, Armstrong is accompanied by a photographer, two cameramen, a mechanic and his representative.

The photographer with Armstrong is Ezra Shaw of the well-known agency, Getty Images. "It is the most important photo business in the world.  They are famous for having many Pulitzer prizes, for photos in wars like Vietnam, the shooting of John F. Kennedy, the death of Martin Luther King, the Challenger, the man on the moon. That's Getty Images and he comes to Costa Rica to take pictures in La Ruta," said Urbina.

According to Urbina, this famous competition, Ruta de Los Conquistadores, has gone through the lenses of the New York Times, ESPN, CBS, ABC, Velo News and Bike magazine, among others. Coverage has been provided by, “about 100 different magazines from European countries such as Spain, England, Austria, going through media from Japan, the Himalayas, Australia, Israel, around the world."

The American cyclist Armstrong won seven consecutive wins of the Tour de France between 1999 and 2005 and a bronze medal in the Olympic Games in Sydney 2000. On June 13, 2012 the US Anti-Doping Agency accused him of systematic doping. The seven victories were withdrawn and he was suspended for life. He then admitted to using EPO, testosterone and blood transfusions improve his performance.

In 1996 he was found to have cancer in a testicle but he recovered and returned to competition two years later.

Some 400 cyclists from around the world will run the Route of the Conquerors this week in Costa Rica. It is a tough competition that crosses the Pacific to the Caribbean.

The cyclists will participate from November 1 to 3 in one of the toughest international cycling competitions. It consists of three stages with a total of 226 kilometers through rivers, mountains and streets.

The first stage of the race consists of 86 kilometers between Jacó Beach, province of Puntarenas (Pacific) and Ciudad Colón, province of San José (center).

The second will go from Tres Rios, Cartago province (center) to Turrialba, Cartago (east) for 80 kilometers, and the last 60 kilometers will depart from Siquirres to  Bonita beach, both locations in the province of Limón (Caribbean).

In the three days of the race the cyclists will travel 226 kilometers, and will add 6,764 meters of accumulated ascent and 6,701 meters of descent.

In this twenty-sixth edition of the Route of the Conquerors, Spaniard Josep Betalú will try to repeat his win of last year, while the American Lance Armstrong will debut in this event.

"At the Route we are saying that there are second chances, this is a personal growth competition and I am sure that Lance will grow personally after this event. I've never done anything similar in the past in mountain biking," said Urbina.

Cyclists from countries such as the United States, Canada, Mexico, Nicaragua, Colombia, Argentina, Ecuador, Spain, the United Kingdom, Costa Rica, Denmark and Singapore will participate in this year's edition of the race.

Increase in exchange rate continues

The exchange rate of the dollar continues its bullish course and touches new maximum figures, both in the Foreign Currency Market (Monex), as well as in the windows of banks.

On Tuesday, at the closing of the day of transactions in the wholesale market, the report showed a weighted average of
608.94 colones and operations that have closed at 610.29 colones, inclusive.

Meanwhile, the banks' windows report an sales exchange rate in a range between
611 and 614.50 colones.

Since September, the exchange rate has presented an upward rally, amid uncertainty about the future of the tax reform.

According to the Central Bank, "the pressure on the exchange rate observed in September and October is consistent with a lower availability of foreign currency in the Costa Rican market."

In addition, the bank's report blames uncertainty in the country's finances, as part of the cause of the increase in the value of the dollar. "Although the seasonality that characterizes these months affected this behavior, the lack of a solution to the structural problem of the public finances generates uncertainty among some economic agents, increasing demand for foreign currency."

Private banks reported the highest rate as Financiera Desyfin  at ₡616 colones.

The pressure on the exchange rate observed in September
and October is consistent with a lower availability of
foreign currency in the Costa Rican market.



The National Bank registered the dollar at ₡613 colones, Banco de Costa Rica and Banco Popular at ₡614.50 colones.

The week started with a greater tendency towards the rise in the exchange rate after the Central Bank raised the reference price. This Tuesday, the governing body had the sale price in ₡605 colones.

Tomorrow the Central Bank will raise the reference price to ₡610 colones, so a new increase is expected in the other banks.

National Emergency Commission cancels all alerts

According to the report of the National Meteorological Institute, the influence of the Tropical Storm that came from Mexico has already left the country,  so the National Emergency Commission cancels the green alert that it maintained in some places of the country.

The commission states that their monitoring “indicates clear conditions and without rain practically in all the national territory."

The commission had maintained an alert in the Central and South Pacific, as well as in the North Zone and the Caribbean. Now, however, meteorologists state that the country is in the transition stage to summer weather so the commission decided to cancel all the alerts.

According to the meteorologist, as part of the transition period during a large part of the week the winds will be moderate and the humidity and rain in the country will decrease.

In recent weeks, due to heavy rains, the commission kept 21 temporary shelters open where it served 1,374 people.

Those in shelters were at risk because of floods, landslides and strong winds, mainly in Nandayure, Hojancha, Nicoya, Santa Cruz, Carillo, Puntarenas and Paquera.
