President Carlos Alvarado vetoed the law known as “Ley de Voto Informado" ( information on voting in the English language), which seeks to reform article 148 of the Electoral Code. According to the president, this veto was done to ensure that Congress reviews the law and proceeds with the mandatory consultation of the law to the Supreme Electoral Tribunal, which is the official public organization in charge of regulating the presidential elections in the country. That review process is established in the Political Constitution. Once the review process is completed by the Tribunal, the law would become enacted without any constitutionality problem. The Voto Informado Law has the goal of providing transparency on the information about the elections. Following this law, the political parties are required to present government plans, photographs and biographies of their candidates for the presidency, vice presidencies and councils. Actions that president Alvarado said he fully supports. The law was approved unanimously on Wednesday by Congress. Then it was sent to President Alvarado for his signature. On Thursday the Supreme Electoral Tribunal informed the president of the existence of a possible error in the procedure carried out in Congress. The review procedure was carried out by specialists from Congress and the Tribunal when the law was approved. However, the president decided to veto the law and return the text to Congress for a more accurate analysis. The political constitution allows a president to veto a law when there is doubt about a possible error that could be made during the process of creating and approving laws. “With adherence and respectful exercise of the powers granted within the democratic State of Law, the Presidency proceeds to return the bill number 10,018 to the Congress, without the corresponding sanction due to the present act of veto for reasons of unconstitutionality, so that amends the possible procedural flaw and subsequently makes it possible to make it a Law of the Republic as it corresponds,” Alvarado said. Congress must review the procedure for the creation of this law.
