for hotel closure

The Ministry of Finance clarified Thursday, the reasons that caused the closure for five days of the Hotel Wyndham Herradura located in Belén, de Heredia. According to the ministry, the company Bonanza, owner of the hotel, has a debt of about $3,249,102 in taxes. These are sales taxes and income taxes. Of the total of unpaid taxes, there are approximately $3,198,087 in the process of judicial collection, said the ministry. "The debts of the company began to accumulate since 2013, and to date, the company still not make the payment," said the ministry in its statement. "In the collecting process has been included notification of administrative collection, notification of judicial collection and establishment of precautionary measures such as the seizure of assets and frozen bank accounts." The ministry has said that it has followed the process of the Code of Tax Rules and Procedures concerning delayed payment cases. "During the closing process, the protocol for closing business was complied with, as to keep the safety of those who were in the place, in this case, guests, workers and officials of the General Directorate of Taxation," said the ministry. According to the ministry, the sanction of closing the hotel is part of the obligations to collect the taxes established by law. Wednesday the ministry sent the Fiscal Control Police to closed the hotel as a precautionary measure due to the alleged lack of payment of sales taxes. According to the authorities of the Department of Direct Taxation, the hotel did file the tax report with the Ministry of Finance, but the sales taxes charged to customers for lodging and other services provided by the hotel were not paid to the ministry. According to Direct Taxation, when a company presents the sales tax report with the corresponding tax calculated amount, it must pay taxes to the state because all companies are facilitators of collecting taxes imposed by the government. In the case of the hotel, the ministry said that the sales reports were made, but taxes were not paid. According to the Direct Taxation, the tax control police proceeded to put closing seals at the entrance doors to the rooms that were not being used by the customers. Also, the entrance to common areas such as event salons, restaurants and bars, among others, were sealed. The execution of this sanction will not affect the guests who are already installed in the hotel, said Direct Taxation. That means all guests do not have to book another hotel. They can continue with their stay until the date they had scheduled to leave the hotel. According to Direct Taxation, the temporary closure of the hotel is part of a process to collect the amount of money claimed as unpaid. According to Gustavo Araya, spokesman of the hotel, in statements in local media, the closure measure was abusive by the authorities because the hotel is 100% booked, which means approximately 500 people are staying at the hotel. According to the information posted by the hotel on its website, in addition to the rooms, the facility has three swimming pools, a fitness center, a sauna, five jacuzzis, a spa, a beauty salon, variety of local crafts and souvenirs shop, a business center, among others amenities.
