A case of fraudulent administration
with shades of domestic violence

A divorce after twenty years of marriage is not easy to overcome, and Tom knew it, but he had decided to live his life intensively, anyway, people live only once. Every Sunday in church, Tom´s ex wife, Krystal, listen to Priest Patterson´s promises about Paradise and eternal life, but that did not matter when she became unfaithful to him.
Tom made up his mind, packed his clothes and decided to come to Costa Rica with an idea in mind: 55 years of age is nothing, He could fall in love again. He arrived here on a rainy morning, May 2017. Tom did not care about the weather; he had decided to come see the Promised Land in a pretty place on the Pacific, Jaco.
Once in Jaco, Tom stayed in a comfortable, discreet hotel, which was important for him since he had decided to live his sexuality to the maximum after hiding it from everybody, even from his wife. It was time to live his bisexual life, and be able to fall in love with whomever he wanted.
After two years, Tom established himself in an elegant condominium outside Jaco. Every Tuesday he went to the casino and there he met Carlos, a twenty years old young man who used to work at the casino selling cigarettes, and frequently wink an eye to him. The time passed and Tom became interested in Carlos, to the point that some weeks later Carlos had keys of Tom´s apartment and was in charge of buying his medication.
Soon after, Carlos went from ordering medications to making wire transfers from Tom´s accounts, paying his cards, his mortgage, etc. No doubt, Carlos was very efficient. One day Tom checked his mail and saw he had notices about non-paid fees especially an important one from his main credit card, the balance was $50,000. Concerned about it he checked his bank account report and found out Carlos had made transference to his own bank account.
Twenty years of marriage teach you to be cautious when starting a discussion with your partner, so Tom waited until after dinner to ask Carlos in a relax way for explanations. Carlos became desperate, started yielding, he hit himself against the walls, he cried asking Tom to stop hitting him, he became violent against himself causing himself a hematoma on his right cheek bone. The condominium security called the police, and minutes later when they arrived they saw the young man injured and hysterical, they decided to detain the presumed aggressor, Tom.
Tom was transferred to the cells of the Judicial Investigation Office. He talked to two judicial assistants, two defense attorneys who did not speak English, he saw two judges, and then he was left free once the judge dictated a series of warnings about not been able to go back to his condo because Carlos was living there, but Tom had to continue paying for it, otherwise he could lose it.
This situation can be qualified as Fraudulent Administration and be investigated by the Public Ministry. To have proper legal advice is of vital importance.
