AmCham asks government to follow OECD guidelines |

The Costa Rican - North American Chamber of Commerce (AmCham), made a call to the government to immediately accept the guidelines of the Organization for Economic Cooperation and Development (OECD) in relation to public agreements. According to the Chamber, the OECD guidelines seek to guarantee procedures are open to competition, non-discrimination and in compliance with adequate transparency standards, all with the aim of guaranteeing the best use of government resources "in moments of recognized fiscal problems." The concern of the Chamber members started with denunciations made by several deputies about alleged abusive use of direct agreements between government institutions, like ICE, RACSA, and others. "It does not seem to respond to criteria of efficiency and effectiveness but to a practice of avoiding the participation of private companies in a competitive environment," said AmCham in its statement. Elías Soley, President of AmCham, remarked, "hiring procedures should not be used to artificially maintain public companies which have not managed to operate efficiently in a competitive market." According to the Chamber, public companies must respond to the interests of the community and satisfy a public purpose. If those companies have stopped fulfilling that purpose, authorities should evaluate them and decide on whether or not to continue that institution, instead of sustaining them through direct contracts that undermine the efficiency and effectiveness of public management and the sound administration of government resources. Soley said that this situation contrasts with the public guidelines that the country must adopt in its process of joining the OECD. |

The Chamber calls on the government to adopt the OECD guidelines on governance of public institutions. “These valuable recommendations (referring to OECD guidelines) remind us that when public companies intervene in public agreements, the procedures must be open to competition, not discriminatory [practices] and ensure compliance with adequate transparency standards," said Elías Soley. ------------- What should the government do to avoid agreements that are just between public institutions?
