Minister of Education asks for a guarantee
of lesson continuity during strikes

Edgar Mora- Altamirano, Minister of Public Education appeared before the deputies of the Special Commission on the Right to Strike in the Legislative Assembly, where file #21049, known as the "Law to Provide Legal Security on the Strike and its Procedures" is being analyzed.

According to Minister Mora, the strikes of employees of the Ministry of Education went against fundamental principles of the rights of students to education, security, mental health, and nutrition, "education should be considered an essential service, but mainly the continuity of the school year should be guaranteed in the face of future strikes."

The strike of the employees of the Ministry of Education, which began in September 2018, lasted 89 days. During that time a large number of students were unable to attend classes due to the lack of teachers.

The Ministry of Education had to improvise solutions to the problems that students had to complete the courses and pass the degree.

For example, the final exams of the last trimester were eliminated, so that the final average did not negatively affect the students' grades for those who did not receive classes during that last quarter of the school year, between September and December 2018.

Related to the latest statements by Ministers before the commission of deputies, as reported by AM Costa Rica, on March 21, Michael Soto, Ministry of Security said its ministry spent more than $1.4 million due to last year's strikes.

The payment of salaries and food services for the police officers who had to patrol the different activities carried out by the members of the unions in last year's strikes cost approximately ¢860 million colones (about $1,442,178), said Minister Soto.

According to Ministry records, around 1,500 police officers were required to deal with situations that occurred in almost the entire country during the strike period.

"From peaceful demonstrations to blockades of roads and "tortuguismo" (referring to obstruction of the roads by the marches of the unions) that is a difficulty for the transit of people, merchandise and vehicles had to be attended," said Minister Soto.

The word "tortuguismo" is a popular Spanish word, from the word ‘tortugo’ and means go-slow or slowdown. It is a reference to slowing down work or walking slowly in the street to interrupt traffic.

One of the biggest problems faced by the police was the so-called "tortuguismo", since there is a legal vacuum in the face of such situations, so the Minister called on the deputies to take into account the specific term "tortuguismo" at the time to include it in the new law.

According to Minister Mora, the strikes of employees of the Ministry of Education went against fundamental principles of the rights of students to education, security, mental health, and nutrition.

Attending to strike demonstrations forced to decrease in the number of policemen who could work to provide security for citizens because they had to reinforce the operations on the blockades caused by the members of the unions.

Among the reforms that will be introduced in the bill #21049, to reform of the Labor Code are:

- Clearly define when the strike is declared illegal.

- Eliminate the salary of the workers during the entire time they are on strike.

- Establish a procedure for the reinstatement to work for employees who are on strike.

- Define the prohibition of strikes for employees belonging to institutions that provide services classified as essential.

The deputies of the Special Commission of Right to Strike will continue with the analysis of the proposed law, which will be sent to the deputies in the Legislative Assembly.
