Costa Rica reopens criminal case against Alejandro Toledo, former president of Peru

The Attorney General of the Republic of Costa Rica, Emilia Navas Aparicio yesterday ordered the reopening of the case against the former president of Peru, Alejandro Toledo and four other people.

The case is processed under file 13-000051-0618-PE.

Authorities in Peru and Brazil had warned that about 17 million dollars in alleged bribes, paid by the Brazilian construction company Odebrecht, were mobilized to bank accounts of corporations in Costa Rica.

The Judicial Branch of Peru investigated Odebrecht for the presumed distribution of $29 million in bribes between 2005 and 2014 in favor of President Alejandro Toledo (2001-2006) and President Ollanta Humala (2011-2016).

The criminal case in Costa Rica, as indicated by the Public Ministry, was reactivated against Toledo, his mother-in-law, the security officer of his Government, and his brother as well as another businessman.

According to Navas Aparicio, this case is one of those being analyzed since the beginning of her administration, on October 13, in order to determine if re opening was possible.

Alejandro Toledo is the target of authorities in Peru for allegedly receiving millions of dollars in bribes from the Brazilian construction giant, Odebrecht.

"We determined that the case requires further analysis and that it is appropriate to carry out investigative measures that had been omitted, in order to find useful and pertinent elements of judgment so that the final decision is the most appropriate," the Attorney General explained in the resolution presented on Wednesday before the Criminal Court of the First Judicial Circuit of San José.

Former Ombudsman will go to trial for only 39 felonies

The description of many criminal actions and the lack of clarity in the fiscal accusations freed the former Ombudsman Ofelia Taitelbaum from the most of charges that were opened against her after a domestic worker denounced her. Taitelbaum allegedly used the worker’s name to evade tax payments.

The case was almost buried after two resolutions issued by the Criminal Judge of the Treasury, Carlos López Quintero, on October 13 and 19, in which he issued a final dismissal in favor of Taitelbaum for 65 crimes, and ordered her to go to trial as suspect of committing 39 crimes of use of false documents.

The Deputy Prosecutor for Probity, Transparency and Anticorruption (Fapta) said in a press release that he had challenged both resolutions last week.

"The Prosecutor General's Office, considering that the trial should be opened for the totality of the crimes, appealed the decision of dismissal last Friday and is now waiting for the Criminal Court of Finance resolve the appeal," said the Institution in a press release.

This case against Taitelbaum was opened in 2014, after her domestic worker, from San Carlos, revealed that companies related to the former ombudsman used her name to file tax returns.

By incorporating the domestic worker as a supposed adviser to the companies, the ex-worker would achieve, apparently, a rebate in the payment of taxes.

Taitelbaum, who had started her political career in 1998, became a legislator for the period 2006-2010 , but resigned as a legislator in December 2009, when she was named as the country's Ombudsman . She remained as such until July 7, 2014, when she resigned following the domestic worker's complaint.

Two years and four months after the investigation began, the Prosecutor's Office accused her of committing 104 crimes: 78 of ideological falsehood in conjunction with the use of a false document; 24 of embezzlement use; and two of coercion.

Judge Carlos López, at the preliminary hearing and after analyzing the elements provided, determined that the events occurred between 2004 and 2008 and that they have to do with the alleged inclusion of false information in the income statements of three companies on behalf of Taitelbaum.

Most of the charges filed against Taitelbaum have already been dropped.

Regarding the 24 crimes of embezzlement (using the telephone of the ombudsman' office 24 times for personal calls, the accusation states that they occurred in the period from October 2013 to July 2014.

The judge found that the accusation "does not indicate the name of the people she called, the date and times of the calls. If the content of the call cannot be determined nor the person who received it, we cannot determine that the telephone service was being used improperly"

On the crime of coercion, Judge Carlos Lopez said that this crime is committed by serious threat of physical or moral violence which compels a person to do or to tolerate some unwanted behaviors.

"The Prosecutor's Office does not indicate how this moral violence occurred and the aggrieved party, was compelled to carry out an act contrary to his will," the resolution said.

Medical marihuana bill gets stuck in congress

The legislative faction of the Citizen Action Party (PAC), has denounced the Broad Front Party (FA) for blocking the bill to legalize medical marijuana, through its legislator, Suray Carrillo.

According to the original plan, bill 19,256 was to be discussed and voted on in the Legal Affairs Committee, and although the FA legislator expressed the importance of said law in different aspects, she presented several appeals that delayed the whole process.

The legislator of the PAC and proponent of the bill, Marvin Atencio, said that an agreement was reached between almost all the political parties represented in the commission to approve a substitute text and be able to send it to the Plenary.

"All the parties build a consensus on the regulation of medicinal cannabis," Atencio said. This process of dialogue and reflection is an example of the type of policy required by the country. Unfortunately, the Broad Front Party hinders the progress of the initiative that would contribute to improve the health of many patients and generate much foreign direct investment and thousands of direct and indirect jobs in the country."

The new text that was received by the legislators grants to the Ministry of Health all the powers of regulation, control, inspection and other administrative functions related to the agro-industrial, commercial, investigative, food and medical activities related to cannabis and hemp.

Atencio Delgado stressed that the dialogue has not ended and that now it should be strengthened in order to take into account the observations of the Frente Amplio.

The Medical Marihuana Bill would attract thousands of dollar in foreign investment, according to legislators.

 
The legislator stressed that there are international sources of great social and professional weight that have shown that cannabis is highly efficient for the treatment of various diseases, among which are cancer, AIDS, multiple sclerosis and epilepsy.

He stated that this is an opportunity for the country to strengthen public finances. As an example of this, he mentioned that this law would grant fresh resources to strengthen the pension regime of the Costa Rican Social Security Fund (CCSS).

"We are going to make another effort to negotiate with the Broad Front Party to reach an agreement with them. We need to move forward with this initiative, as there are many people in our country who are waiting for the opportunity to use products derived from cannabis for medicinal purpose," Atencio said.


Otto Guevara proposes to end the electricity monopoly

Otto Guevara, legislator of the Libertarian Party, has presented bill number 20,588, called the “General Electricity Law”, with the purpose of creating a competitive electric market, whose benefits would be transferred to the homes and industrial consumers of Costa Rica.

This initiative proposes that the Costa Rican Electricity Institute (ICE) remain as one of the most important generators and distributors, but that it enters into competition with other private generators, as it has happened in the area of ​​telecommunications.

Within the proposed law, the Ministry of Environment and Energy (MINAE) will be the governing body of the energy sector; and the National Center for Planning and Operation of Electricity (CENPO) will be created. CENPO will be responsible for purchasing, through an auction system, the energy generated by ICE and private companies, to sell it to large consumers and energy distributors.

The Public Services Regulatory Authority (ARESEP) remains the agency in charge of regulating the quality and service rates.

The bill guarantees the principle of universality of the public service and the recovery of energy supply in cases of emergency throughout the national territory. It also recognizes the right of people to generate their own energy in homes and industries, taking advantage of solar, wind, biomass and geothermal energy.

Costa Rica must guarantee the continuous supply of energy with high standards of quality, efficiency and environmental sustainability.

New campaign seeks to decrease violence against seniors

On Wednesday, the Ombudsman's Office launched  an awareness campaign to stop the violence that hundreds of elderly people in the country face daily.

According to data provided by the Social Management Unit of the National Council of the Elderly (Conapam), as of 2017, 854 cases of violence against seniors have been reported in the country. Between January and September, the 911 Emergency System recorded 3,877 reports of aggressions related to seniors, out of which 1,383 were due to intra-family psychological violence and 1,571 due to intra-family physical violence.

"Today the Ombudsman urges to recognize that the indifference towards this reality contributes to increase the mistreatment, disrespect and contempt; these are forms of violence experienced by senior citizens in the privacy of their home, away from the eyes of institutions," said the Ombudsman Montserrat Solano.

There are 440,799 seniors in the country. Official forecast sets that figure at 1,262,311 by 2050; The Ombudsman considers it essential and urgent to adopt measures that instruct the people on the human rights of this population and eradicate the indifference and violence they suffer.

APM terminals facing delays due to infrastructure woes

Three routes are fundamental for the full operation of the new container terminal of Moín, but there are delays in the execution of those routes which limit the potential of the project.

These are route 32, the Fourth, which connects the route 32 with the border crossing at Tablillas and  route 36 that goes from Limón to Sixaola.

The general manager of APM Terminals, Kenneth Waugh, has said on Tuesday that the expansion of the roads is key, because they allow the connection of the dock with the rest of the country and Central America.

A study of these three roads prepared by a consulting company specializing in evaluating large infrastructure projects, talks of their impact at the macro and micro levels, as well as what is necessary to take maximum advantage of opportunities.

Route 4 was recently inaugurated; however, it requires some improvements according to the APM Terminals representatives.

The delays in the extension of the road between San José and Limón are known since the concession was granted to the Chinese company CHEC. This project will take three years to complete, according to the projections.

The third route that worries the concessionaire is the one that connects Limón with Sixaola, since it allows communication with the border with Panama.

"At this moment, that road has 13 or 16 bridges of only one way, generating limited transit especially if what is going to be mobilized is merchandise and cargo," added the spokesman.

The concessionaire thinks about the potential of Central America and especially the neighboring countries of Costa Rica, for example, the Panamanian banana plantations that would be closer to the Moín dock than the Canal to carry the exports.

On July 2016 , the company announced that the delivery of the project would have to be postponed until February 2018.

Legislators will enjoy new congress building

The new building that will house the congress will begin its construction in February 2018, according to the plans.

The director of the Legislative Assembly, Antonio Ayales, said that they are in the final phase of analysis of the proposals of companies that participated in the bid to build the $90 million project.

In total, seven companies submitted their offers, of which four are Costa Rican.

"The bidding for the building was published in March and the offers were received in June, some of them with budgets within the margin we established, and from July, August and September we were in the bid analysis period by the project unit," said the director of the Legislative Assembly.

Ayales also said that the offers have already gone through the filters of the Bank of Costa Rica (BCR) and the Congress itself as auditors of the process and expects the work to be granted in two weeks.

BCR administers the trust for the financing of the project, whose completion is expected by 2020.

On March 13, the demolition of the old library of the Legislature marked the initial point of the project.

Ayales said that the work came at a good pace until recent months when the increase in rainfall in the country hindered the progress of the works.

Due to unforeseen events this phase of the project could be extended until January next year.

"At this moment the bidding of the administrative unit has an 80% progress, and it has to be finished by December, but we have had delays due to the amount of rain that has affected the extraction of the soil and its disposal," Ayales explained.

Although it is a delay, the director of the Assembly considers that it does not generate a great impact on the planned schedule, but they hope that the weather conditions do not continue to hinder the process.

The current design faced a series of setbacks. One of the most notable was the refusal of the Center for Research and Conservation of the Costa Rican Heritage (CICPC) to give permission for the property, arguing that it would minimize other declared heritage buildings in the surroundings.

The infrastructure will be on the west side with a window of six meters wide by 15 meters high and around it will have windows of 1.80 meters high by 60 cm wide. This design will allow the internal temperature to be maintained at 24 degrees, saving the need to activate air conditioning.

The property will be partially powered by solar and wind energy. In addition there will be both a garden in its upper floor and a square in the center.

The building includes a tunnel to connect to the old building and a parking area for legislators and officials.

The construction of a square on Calle 15 between avenues 0 and 1 (west of the current Congress) was added. The intention is to interconnect the National Park and the Plaza de la Democracia.

says study

During 2016 and the beginning of 2017, Costa Rica registered important economic and social advances in strategic indicators, in which economic growth, social investment and the reduction of poverty and unemployment stand out, as well as the reduction of conflicts.

Those are some of the main conclusions found on the 23rd State of the Nation Report, presented to citizens on Wednesday. The document analyzes the national reality through quantifiable data from 2016 to the beginning of 2017.

The research says there is an improvement in support for democracy and political tolerance, which reversed a trend of erosion of both indicators in the long term.

However, the report points out structural problems that Costa Rica has been dragging on since 1994, which hinder the sustainability of good economic and social results, such as the country's difficulty in reaching agreements.

"We take note of this situation and renew our commitment to continue working for the improvement of these situations throughout the national territory, and continue to contribute to the solution of national challenges," said the President, Luis Guillermo Solís Rivera.

According to this report, the Solís Rivera Administration achieved a fiscal deficit of 5.2%, the lowest in the last five years, as well as the reduction in the lowest wage expenditure in the last decade, registering a growth of only 3%.

The trend of economic growth in recent years continues. During the last year, the export sector was reactivated by 42% and the economic growth of the country was 4.3%.

In terms of human development, the increase in social investment continues to be one of the main characteristics of this government reaching a total investment of ¢7 billion.

Programs targeting groups in situations of poverty, vulnerability or social exclusion grew the most in 2016, with an increase of 6.4%. The real increase compared to the previous year was 3.5%; which represents a real expansion of 2.2%, equivalent to ¢1.4 million per year.

All this was has been accompanied by a boost in industrial, agricultural, and commercial growth, as well as specialized and non-specialized services in the national productive sector.

The report also points out the significant decrease in unemployment. This result is due to the creation of more than 64,000 new jobs and a substantial improvement in the conditions for less qualified workers, with an informal employment growth of 8%, said the research.

Last year poverty decreased by 1.2%, the lowest indicator in the last 7 years, with a substantive reduction of rural poverty, which went from 30.3% in 2014 to 25.7% in 2016. In the Chorotega Region, this improvement meant that poverty decreased from 33.2% to 23.6%.

These results are also framed in a low social conflict. This is the second consecutive year in which the country's social peace stands out, accounting for the greatest stability since 2014.

During this period, 92 laws that substantially increase the legislation on human rights have been approved, also legislation limiting abusive pensions.

President against 4% tax on books proposed
by his finance ministry

The tax of 4% on books proposed by the Ministry of Finance, made President, Luis Guillermo Solís very unhappy.

The Government presented a new version of the fiscal reform bill last week in order to achieve consensus in the Congress, where the initiatives related to the issue face a lot of obstacles.

"As a teacher, educator, as a bibliophile very badly tamed by a mother who taught me to read stories from a very young age, and as President of a country where a very high percentage of his gross domestic product is invested in education, it seems to me that we send a message that is not positive when putting taxes on books, "said the President.

Faced with this situation, Solís asked the Finance Minister, Helio Fallas, to reverse this proposal.

The tax cannot be withdrawn with the proposal already sent, so it will be the job of the Ministry to propose its withdrawal during the negotiations that take place in the Congress.

"Don Helio Fallas has told me that he will analyze and provide an important consideration to the request in the next debates," said the President.

The Executive Branch raised two tax rates on value added tax (VAT), which are 13 percent and an additional 4 percent for certain goods and services. This is where the books are included.

That differentiated 4% tax would also affect the price of plane tickets.

In its new version of a fiscal project, the executive included proposals to increase the taxpayer base in the value added tax, and in turn establish changes in public salaries. The text seeks to avoid the rejection that has already suffered on the part of most of the political parties that criticized it for not containing enough spending cuts.
