Former president Arias called for judicial hearing

The ex-president of Costa Rica and Nobel Peace Prize winner, Oscar Arias, appeared Wednesday night before the Prosecutor's Office to give a statement on the case of the failed Crucitas Gold Mining Project.

Arias, president from 1986-1990 and 2006-2010, had a private audience and did not answer questions from the press before entering the facilities.

The Costa Rican attorney general, Emilia Navas, who took office on October 13, reopened this case that had been dismissed by his predecessor, Jorge Chavarria.

Chavarría has been suspended by the magistrates for alleged irregularities in the dismissal of another case.

The case of Arias refers to the alleged crime of malfeasance (issuing resolutions contrary to the law or based on false facts) by signing a decree, in 2008, declaring the Crucitas gold mining project of national interest. Crucitas was never fully built and never exported any gold.

The decree of national interest could have smoothed the way for the approval of a series of permits to alloy Infinity Industries to begin mining. Infinity Industries belong to the Canadian firm, Infinity Gold.

The former prosecutor did not include former President Arias in the indictment. Instead, his Minister of Environment and Energy, Roberto Dobles, who also signed the decrees, was included.

In 2015, a criminal court sentenced former minister Doubles to three years in prison for the crime of malfeasance, but days later the sentence was voided by the Court of Appeal which ordered a new trial, held last September.

In this new trial, the criminal court issued a resolution to return the case to the intermediate stage of preliminary hearing, in which the Prosecutor's Office was to determine whether Óscar Arias should be also investigated.

The place where the mine was to be installed is currently invaded by hundreds of artisanal miners who use dangerous methods, such as the use of mercury, to extract gold from rocks.

New regulations apply for purchases made over Internet

Those who make purchases from online companies located in Costa Rica now have more tools to enforce their rights.

On October 25, the official daily La Gaceta, published a reform to the Law on Promotion and Effective Competition and Defense of the Consumer, which introduces a specific chapter to better define national electronic commerce.

The reform sheds light on some of the doubts in these transactions and includes requirements for businesses that offer their services and products through electronic platforms, including social networks.


The new regulation on electronic commerce obligates businesses to provide more and better information about what they are offering.

According to the reform, the consumer must have total clarity about the corporate name that is behind the brand, product or service, as well as contact information, in case of complaints or queries after the purchase.

Additionally, a clear description about the procedures and means to make the claims, the delivery time, how services will be executed and any other data that is useful for the consumer must be included.

Among the new rules is that the right of withdrawal is extended. This tool, used for home sales, now covers sales by electronic means.

It consists of a minimum period of eight business days where buyers may decide if the purchase do not satisfy them and ask to return the item for a refund.

The right of withdrawal does not apply to items that, due to their nature, cannot be returned, such as perishable goods.

Buyer's will have at least eight days to reconsider the purchase.
The terms of the contract should be in Spanish, the price of the purchase should be final, including all taxes and commissions, a legal guarantee and how to enforce it are among the changes.

There must also be a proof of purchase delivered to the consumer electronically. There should also be clarity about after-sales assistance and product life.

If it is not possible to set the final price, the seller must clearly established the methodology of how cost will be calculated, such as minimum rates per unit of time or distance.

Lastly, companies are obliged to provide an evaluation system the consumer may complete voluntarily.

Buying products or subscribing to services online does not have to be a traumatic experience nor does it have to leave consumers defenseless, much less if the product is being offered within the Costa Rican borders, said the Ministry of Economy, Industry and Commerce.

Costa Rica was the role model for
Catalonian Independent Activist

The dismissed Government of Catalonia, which supported a unilateral declaration of independence, aimed to establish a pacifist state following the Costa Rican model.

This was revealed on Thursday by the EFE agency, citing a police report detailing the plans of the person who would be the head of the Catalan government, once they declare themselves as an independent state.

The government, as it is known in Spain, would have proposed that Catalonia be a pacifist state without a standing army, following the example of Costa Rica, stipulating that in case of risk situations, they would not rule out seeking external support.

According to another publication of the newspaper El Mundo de España, another project proposed by the Catalan secessionists was to provide at least five police units to cover the operations currently carried out by the Spanish state.


The newspaper learned about the plans in a report seized by the Guard Civil and titled " The security of the Catalan Republic; first approaches ".

One person dies everyday due to diabetes

Every day, a life is lost to diabetes mellitus and every week 10 people suffer the amputation of a limb due to the disease.


In order to reduce the number of patients who are diagnosed each year or lose their lives as a result of complications, the Costa Rican Social Security Fund (CCSS) presented a new model to approach the situation on Thursday.

This model focuses on prevention and not just on the treatment of the disease. This change of strategy also focuses on the inclusion of physical exercise, healthy nutrition and breastfeeding as a protector of chronic diseases. The CCSS has already hired seven health promoters, who will work along with physical educators and nutritionists.

As part of the of the celebration of the “World Day Against Diabetes,” which is commemorated on November 14, Eugenia Villalta, Medical Manager, said that in 2016, there were 420 ,000 consultations about diabetes.

"Diabetes is increasing and the most troubling is it attacks all organs, people can go blind or have kidney problems, but they do not know it," said Villalta.

Raúl Sánchez, Director of the Directorate of Development, said that it is a disease that has high costs for social security.

"The institution has determined that it is not only the illness that must be taken care of, but also the self-care of the people, because the health services are not the only ones responsible," explained Sánchez.

According to experts, diabetes is among the most expensive diseases treated by CCSS.

Javier Céspedes, coordinator of the Optimal Diabetes Control Program, explained they will create 278 new places for promoters, nutritionists and physical educators throughout the country to serve the population.

This strategy also includes the application, every six months, of a test called glycosylated hemoglobin which allows doctors to know if patients are following healthy lifestyles and are controlling the disease. This would avoid complications and amputations.

This year the pilot plan was implemented in Heredia and next year it will be extended to Guanacaste. The sites were chosen for their incidence of cardiovascular diseases.

Forty two consulates will be available for voting abroad

Costa Ricans residing in 42 different countries may exercise their right to vote on February 4, as confirmed by the Supreme Electoral Tribunal (TSE).

A total of 52 consulates presented requests for inclusion in the voting process. Requests had to indicate a location or locations where polling stations would be installed.  


Of all the consulates, only three stations will not be found in the consulate offices themselves.

These exceptions are the consulate of New York in the United States, which was moved to the Best Western Robert Treat Hotel, the consulate resident in Panama City in Panama, which moved to the Hilton Panama Hotel, and the consulate of Madrid, Spain where the voting center will be in the Ibero-American Conservatory Room of the Ibero-American General Secretariat.

Paola Alvarado stated that voting stations were moved due to the number of people registered. This was confirmed by the individual in charge of the electoral voting program abroad.

The Supreme Electoral Tribunal is preparing to assist all those who decide to attend the polls on February 4, 2018. In total, the TSE handles a provisional figure of 3,313,404 voters, among whom are Costa Rican citizens residing in foreign countries.

Taxi drivers seek to file a complaint
against legislator Otto Guevara

Yesterday, the guild of taxi drivers urged their members to show up before the Public Ethics Office and the Public Ministry to file a complaint against legislator Otto Guevara for apparent influence peddling. The meeting took place at Avenida Segunda, 50 meters south of the Plaza de la Democracia.

According to Gilberth Ureña, leader of the National Forum of Taxi Drivers, "the information we have is that Otto Guevara has met several times with Germán Valverde, Minister of Public Works and Transport and as a result, authorities of the Ministry of Public Works and Transportation(MOPT) have had several meetings with representatives of  Uber; a company that Luis Guillermo Solís, President of the Republic declared illegal based on the votes from the Constitutional Chamber. "

The leader said they hope these meetings will be investigated.  "We want the Public Prosecutor's Office and the Office of Public Ethics to look for the MOPT logs and videos to know how many times the legislator entered and left. As citizens, we ask for transparency. "

Guevara's support to Uber services in Costa Rica has ignited the anger of taxi drivers.
"The suspicions [are] that these meetings were related to the Uber issue. Guevara has insisted that illegality to prevail in terms of transport like Uber," Ureña added.

Guevara had not issued any statement as of deadline.

Cañas to host its biggest cultural festival

Folk dances, songs, storytelling, traditional games, crafts, food, music and many other things make up the  cultural event of "Cañero Festival: Impulse to Traditions" which will be held tomorrow and Saturday, November 10 and 11, at the Municipal Hall, in Cañas, Guanacaste.

"Several organizations approached for spaces of community representation and spaces for artistic and cultural expression, productive ideas and cultural manifestations," said the Ministry of Culture and Youth.

The Cañero Cultural Festival has the support of the Municipality of Cañas, the Culture Committee of Cañas, the Territorial INDER Council in Abangares, Bagaces, Cañas and Tilarán, the Parish of Cañas, Professional Technical College of Cañas and independent cultural managers.

"The Festival also seeks to provide recreational spaces for the enjoyment of cultural expressions from Cañas, as well as publicize the cultural heritage in its various manifestations such as: gastronomy, agriculture, crafts, among others." added the Ministry on a press statement.

The Witching Hour

Five minutes after arriving, Ty told Sheila he'd never been to such a strange Halloween party. 

“Realistic is the term I'd use,” Sheila replied.

Liz, the hostess and owner of a Barrio Amón hobby shop, had told them the theme was animals, but they never anticipated anything like what they found. Sheila was in a black cat outfit and Ty was the big bad wolf, but anyone could tell they were a beautiful woman and a handsome man. The others looked like real animals. One could imagine the lion stalking through the Tanzanian Serengeti. The jaguar prowling the Oso jungle, the crocodile floating through the River Tarcoles. The gorilla swung from the chandelier and the python slithered along the floor.

“Liz, why'd you rent us such unrealistic costumes when you had outfits like that available?” asked Ty.

“They don't rent from me,” she replied. “They're individualistic.”

“And why are you dressed as a witch instead of an animal?” Sheila asked.

“It fits me, don't you think?” said Liz.

They admitted it. They'd privately joked that with her crooked teeth and hair growing on the top of her bent nose, all she needed was a pointed hat and a broom to be the perfect witch. Now she had both, and looked the part.

As the party wore on, Ty and Sheila tried to strike up conversations with the other guests, but were soundly rebuffed. A few appeared to check them out at a distance, but walked off when the couple tried to approach. Neither Ty nor Sheila remembered seeing any of them around Costa Rica. 

As midnight neared, they went to their hostess and told her they were leaving.

“You can't go now,” Liz protested. “It's about to strike midnight, the witching hour.”

“The what?”

“The witching hour. For one hour, everyone changes. I can't predict what will happen to the others, but you two will become a real black cat and a big bad wolf.”

“Yeah, sure,” sniffed Ty. “Well, you all have fun, but you'll do so without us.”

“I beseech thee,” pleaded Liz. She put a hand to her mouth, but her guests were already near the door and showed no sign they'd heard the words. All eyes were on the departing couple as they opened the door to leave. 

When Ty closed the door behind them, the clock struck midnight and the doorknob twisted in his claw. 

Claw? What the . . .? Ty stared at the claw for a moment, then took stock of himself. It had happened. He had become a wolf. His sharp grey eyes scanned the area for Sheila, but she was nowhere in sight. Something scratched his hind leg and he looked down to see a black cat staring up at him.

“Sheila?” he snarled.

“Yes,” she purred. “Ty, we've become animals.”

“What should we do?” he growled.

“Liz said it would last an hour,” She reminded him, her voice a soft trill. “Let's go home. It will all be over soon.”

“Good idea,” he said. “But, neither of us can drive like this.”

“Right now, walking will be easy. We'll be home in fifteen minutes.”

“Good point,” he agreed. “Let's go.”

They started to walk, Sheila scurrying as fast as her little paws could move.

They'd barely left the property when a very large man dressed in a hunter's outfit stepped out from the bushes to block their way. At the same time, a panel truck drove out of a driveway in front of them. The driver got out and opened a sliding side door.

The driver scooped up Sheila and put her in the truck. The large hunter grabbed Ty by the scuff of his neck, ignoring the sharp wolf's teeth and claws – which Ty had no idea how to use – and tossed him in the truck beside Sheila. The hunter lumbered up into the truck and the driver slid the door shut and locked it.
A minute later they were speeding away.

“Look,” Ty said, “I understand your mistake, but I assure you I'm not a wolf. It's just some kind of crazy spell that Liz must have put on us. In forty-five minutes, I'll be a man again, and Sheila here will be a beautiful woman. Then we can laugh this off, have a drink, and get on with our lives.”

The hunter looked at his watch and nodded. He put a finger to his lips to let Ty know he wished him to stop talking.

“The strong, silent type,” purred Sheila. “Impressive, but I'm sure we'll talk later.”

No one spoke as they drove out of San José. Ty thought he recognized the highway to Limon. They turned off on a road that zig-zagged through a dense, mountainous jungle. Sheila couldn't see out, but she could feel the ruts and bumps in the road as the truck climbed. Finally, at ten minutes before one, they came to a stop. It was dark, but newly acquired animals senses told them they were in a heavily wooded area near a lake or a river. The driver got out and opened the door. He grabbed Sheila and carried her into a cave, first stopping to light a torch. The big hunter draped Ty over is shoulders and followed.

When all were inside the cave and another torch was lit to provide a little wavering light, Ty whistled. “Man,” he snarled, “you being hunters, I expected rustic, but I thought you'd at least have a cabin. Where do you sleep? How do you cook?”

The hunters exchanged glances, shook their heads and looked at their watches. 

None of Ty's belongings had transformed when he did, so he had no watch. He walked over to look at the big man's watch. “Two minutes before one,” he offered helpfully. “In a couple of minutes, we're going to change back into our real selves, a good-sized man and a tall, beautiful woman. You're going to be enchanted, and I'm sure ashamed, but we'll all have a good laugh, and we can be on our way.”

The hunters sat on large rocks in the middle of the cave. Ty watched the biggest man's watch and the other picked up Sheila so she could view his.

The second hands moved slowly – much too slowly to suit Ty and Sheila – around the watches. 

The first minute seemed to take five. The second was an eternity, but eventually there was but five seconds left.

Then four, three, two, one, and, finally, the second hand passed twelve.

“It's one a.m.,” noted Ty with great relief as he transformed from the two foot tall wolf into a six foot tall man. Sheila slipped to the floor and was dazzling as she once again became a tall, lovely woman, no longer a tiny cat.

“See,” cried Ty triumphantly, but he gasped in frightened dismay as he found he was looking into the blue-green eyes of a hungry crocodile and the yellow eyes of a ferocious jaguar.

First Aid for Stressful Times

We all face stressful situations from time to time. Among the first signals of severe stress is anxiety. The body responds to stress by secreting the stress hormone cortisol. This stimulates the adrenal glands to excrete adrenaline, preparing the body for fight or flight. You may experience physical symptoms such as a pounding heart and sweaty palms. Pulse rate increases, and breathing becomes shallow. Momentary stressful situations like a close call on the highway have no long-term effect, we recover very quickly. But when stress goes on for months or years, depression and even physical illness result. According to the CDC stress either causes or contributes to 90% of all disease.

Here I will be talking about emotional/psychological issues and how they cause anxiety and depression and ways to cope more effectively in demanding situations. Stress inevitably results when we face extreme demands on time and energy, such when you have a new baby. But in this case there is no inner conflict, but exhaustion and concern about doing everything right. Situational stress is not likely to lead to depression or generate extreme anxiety. On the other hand, chronic emotional stress is often caused by inner conflict. Indecision usually comes from fear of making a mistake. Folks can agonize for weeks or even months. The more consequential the choice the more anxiety rises. It is hard to get clear on what we truly need and want.

Under stress the brain secretes a little extra serotonin to sustain your sense of well-being. When stress continues over time the brain will become depleted of serotonin and you are clinically depressed. It reminds me of squeezing a lime. If you squeeze it every day, over time the juice is drained and the lime is dry. It takes time for the brain to recover and you will probably need both psychotherapy and medication. The common symptoms are loss of appetite, compulsive over eating, crying, having trouble sleeping, or sleeping too much and feelings of despair and hopelessness. All the while your immune system is being suppressed. You become more vulnerable to illness.

In the early stages, before these physical symptoms appear there are things you can do to avoid descending into clinical depression. Here is one simple method I have used myself and recommend to clients. In crisis situations there are good days and bad. On bad days it seems impossible to think of anything that might make you feel better. Take time on one of the better days to write a list of things that make you feel good. Keep the list handy. I posted mine on a sticky note on the bathroom mirror. My list included walking on the beach, going to the gym, relaxing in a warm bath, cooking, calling friends, meditating. Of course your list will be unique to you. Be sure to have at least three or four things on the list. Then when a bad day strikes check out the list and choose one and then another.

Feelings of sadness and grief, anger and fear are carried in the body. You may feel tightness or pain in your stomach or chest. This is why exercise is an essential item for your list, especially aerobic exercise such as fast walking, running, swimming or working out in the gym. Deep breathing helps open the chest and allow energy to move.

To defend against negative feelings we naturally tighten up; we use muscle tension and numbing. But the tightness keeps energy locked in place. Holding on to your feelings doesn't help. It just makes the feeling hold on longer. Painful tension will increase almost as if the body is calling demanding your attention.

Actually, feelings form as knots of energy that need to be acknowledged so that they can be released. Acknowledging your feelings, admitting to yourself the truth of how you feel can open the energy and allow it to move through your body like a wave through water. The pain is released, stress is reduced and you feel better going forward. This may sound easy but it requires self-compassion and dropping negative judgment.

There is a way of allowing feelings to move and open so that they can release. It is called Focusing. This is a special method for listening inside to connect directly with the feeling and get the message it is trying to convey. Many therapists teach it. You might want to look into this at www.Focusing.org.

If you don't know Focusing, aerobic breathing opens the chest and helps the tightness to move through. It also releases endorphins in the brain giving a sense of pleasure and well-being. Once the energy opens up you need to pause and pay attention to the sensation. Spend a few minutes listening/sensing into the feeling. In order to do this you must have an attitude of openness and willingness to allow it to speak to you. You may get words or images that seem to fit with the feeling or symbolize it. Stay with the feeling, allowing it to be just as it is. You can recognize a fit because your body will signal with a sensation of relief and release. Connecting with your true feelings allows them to change and the tension will relax. It is important to have willingness to let the feeling be, even if you don't like it.

We cannot legislate our feelings. All our feelings are valid, even when they don't make sense to us. They come naturally to us as we face challenging life situations. There is a good reason you feel the way you do, even when you don't know exactly what that reason is. Being angry or fearful doesn't mean you are weak or a bad person. Probably anyone in your situation would feel the way you do. I know it is difficult not to judge. Most all of us were criticized for being angry or scared when we were children. We are left with a tendency to blame ourselves when things go wrong, even when self-blame is irrational. Taking responsibility is different than blaming. We can acknowledge mistakes we made in the past that may have led up to the situation without blaming. Making a mistake does not qualify as a crime punishable by self-hate.

Healing and releasing pain requires a change of consciousness, letting go of negative judgment and self-blame. The only way to relief and healing is to accept exactly what you feel without fault or blame.


Another way of discovering what is behind your feelings is simple Mindfulness practice. Just sitting in silence with eyes closed is meditation all by itself. In Mindfulness practice we pay close attention to the breath, tracking the inhale and exhale. This brings awareness into your chest and stomach where most feelings are held. The feeling naturally draws your attention. Sitting with your inner experience as we do in meditation gives the body the time it needs to let the true feeling reveal itself bringing the relief you long for.

Not being clear on what you truly need and want is a major cause of inner conflict/stress. Your body clearly speaks its distress when you take time to listen within. Resolving this problem is a key to relaxation and peace. Your body doesn't like stress any more than you do.

This is where good therapy or counseling can be a wonderful support for stressful times. Friends are important, but they have their own problems and may have trouble listening without trying to "fix" it by suggesting a solution. Cognitive Behavioral Therapy works short term, but the improvements don't last because they are not your personal solution. Your own solution is the only one that can work. The answers are within you and only you.

When I think freshly of self-care I am reminded of an unhappy truth. Many of us were not well taken care of as babies and children. Child neglect is rampant in our culture. When we are not cared for as children how can we know how to give ourselves the care we need as adults? We can't. It is just not a part of our operating system, not a built-in habit. Self-care never occurs to us. So we have to learn it all anew. Loving self-care is taught intensively in therapy. It builds self-esteem—the best medicine for these stressful times.

Moody's lowers Banco de Costa Rica credit rating

The risk assessment firm has downgraded state-owned Banco de Costa Rica (BCR) to B1 from Ba3 (the standalone baseline credit assessment (BCA) and adjusted BCA). At the same time, the rating agency affirmed the bank's long-term local currency deposit and foreign currency senior unsecured debt ratings of Ba2, as well as the long-term foreign currency deposit rating of Ba3. The outlook on all ratings remains negative.

Moody's said that the downgrade of BCR's standalone BCA to B1 from Ba3 reflects deepening concerns following the arrests of the bank's former Chief Executive Officer (CEO), its acting CEO and of members of the credit committee, on November third. The arrests relate to allegations of improper terms and conditions of certain loans extended by BCR. On November 6, BCR announced the appointment of the bank's general counsel as the new interim CEO.

Moody's believes these arrests highlight BCR's prior corporate governance weaknesses and will impair the bank's ability to generate new business. BCR's deposits and senior obligations carry an explicit sovereign guarantee, which protects the bank's funding from short-term refinancing risks in times of stress. However, potential further legacy governance shortcomings until the bank's new management is well established in office may lead to a greater internal difficulty to generate new businesses.

Further, Moody's affirmed BCR's long-term and short-term counterparty risk (CR) assessments of Ba2(cr) and Not Prime(cr), along with the bank's short-term local and foreign currency deposit ratings of Not Prime.

The heightened reputation risks for BCR coincide with a declining overall risk appetite by international banks regarding their credit exposures in Central America over the past years. Therefore, BCR may face greater repricing risks when refinancing its external liabilities, largely composed of bank loans and a global senior bond maturing in August 2018.

The political scandals related the importation of Chinese cement struck hard the BCR reputation with investors.


Loan growth will remain further restrained as the newly appointed interim management focuses on strengthening corporate governance rather than growing the portfolio. Hence, BCR's already modest profitability may weaken further. During the first nine months of 2017, BCR's consolidated return on assets stood at just 0.7%, well below the 1.3% Latin American average.

In addition, asset risks at BCR may increase as investigations unfold. In fact, Costa Rica's Superintendency of Financial Institutions (SUGEF) has already required BCR to revisit the internal classifications of specific credit exposures, which would further erode earnings generation. As of September 2017, BCR's nonperforming loans stood at just 2.1% of gross loans, but sudden increases in delinquencies may be possible.

The aforementioned arrests follow the request from Costa Rica's President Luis Guillermo Solis for resignation of BCR's entire Board of Directors on September 26, 2017, after which Moody's downgraded the bank's BCA to ba3 from ba2.
