President Solís under investigation
for alleged illegal appointments

The president of the Republic, Luis Guillermo Solís, said he is willing to cooperate with the Attorney General's Office after finding out that he is under investigating for the crime of apparent illegal appointments.

Presidential House issued a reaction from the president after a publication in Spanish media which revealed that he is one of the 34 members of the government who is under investigation from the Public Ministry.

"The president of the Republic has not been notified of any judicial process against him before the public prosecutor. However, he reiterates his permanent willingness to cooperate in any action that the Prosecutor's Office requires, as we have always done," the statement said.

The case against Solís was opened in 2017, and the crime for which he is being investigated is explained in Article 337 of the Criminal Code of Costa Rica, which states that the public official who proposes or appoints people abusing their authority shall be punished with 30 to 90 days in prison.

Because all cases are under study, the prosecuting agency of the state cannot provide any details.

The Attorney General's Office also has an open case for illegal appointment against the minister of Public Security, Gustavo Mata Vega.

The vice president and minister of Finance, Helio Fallas Venegas, has been charged for breaching his duties. The minister of Labor, Alfredo Hasbum Camacho, is being investigated for the same reason.

For the crime of prevarication, which occurs when resolutions contrary to the law are issued, those being investigated are: the minister of Agriculture, Luis Felipe Arauz Cavalline; the minister of the Environment, Edgar Gutiérrez Espeleta; the minister of Housing, Rosendo Pujol Mesalles; the minister of Planning, Olga Marta Sánchez Oviedo, and Mauricio Ventura Aragón, minister of Tourism.

The other three ministers under investigation are: German Valverde González, minister of Public Works and Transportation, who has two pending investigations alleging falsifying receipts of goods and services; the minister of Education, Sonia Marta Mora, facing allegations of disobedience, and the head of the Health Portfolio, Karen Mayorga Quirós, who is being investigated on allegations influence peddling and abuse of authority.

Emilia Navas, Attorney General, said that 10 legislators and 13 magistrates are also subjects of investigation.

"Regarding possible complaints before the Public Prosecutor's Office against other members of the cabinet, it is important to remember that any person has the right to file a complaint with that body, which must assess the basis of the complaint and decide whether or not it has merit. Denunciation before the Public Ministry in no way prejudges the innocence and probity of the aforementioned persons," adds the press release.

Investigations on 10 legislators from the Legislative Assembly and 13 magistrates of the Supreme Court of Justice are also part of the file.


The Alvarados reach a technical tie in latest poll

Carlos Alvarado of the Citizen Action Party and Fabricio Alvarado of National Restoration maintain a tie almost less than week before the second electoral round, a poll shows.

This is the result of the latest survey of the Center for Research and Political Studies of the University of Costa Rica and published by the Semanario Universidad.

According to the center, Fabricio Alvarado would get 43 percent of the votes and Carlos Alvarado would get 42 percent. In addition, it registers that 15 percent of voters are undecided, a figure that has diminished in the past weeks.

The Citizen Action candidate said that the party will continue to work to convince voters due to the tightness of the results.

The study interviewed 1,202 people through by telephone and said that 31 percent of the voters will not go to the polls on Sunday, April 1.

The survey also says that Carlos Alvarado has most of the support of those who voted for other parties in the first round while Fabricio Alvarado has gained support from those who did not vote previously.

It also shows that 25 percent of Citizen Action voters thinks they will be on vacation that Sunday, which is Easter.

A group, identified as, officials of the University of Costa Rica, sent a letter to the legislator of the National Liberation Party, Rolando González, denouncing the Center for Research and Political Studies of the university and said that the center is manipulating the data of the surveys, favoring Carlos Alvarado.

According to the complaint, the next survey published by this organization will reflect an advantage for the pro-government candidate without giving an explanation of the methodology used. The center maintains favorable biases for the Citizen Action Party, the complaint said.

"We have truthful information according to which, when they had not finished tabulating the results, the CIEP was talking about a result positive to one candidate," says the letter, which was sent to González as president of the Public Expenditure and Income Commission. CIEP is the Spanish acronym for the center.

According to the complainants, state funds are being used to benefit one political party.

The letter states that the center is doing now what they did four years ago to favor Luis Guillermo Solis, who took advantage of it to increase support and win the election in the second round.

According to the CIEP, Fabricio Alvarado has 43 percent of the votes and Carlos Alvarado 42 percent.

Legislator González received the letter, informed the commission and decided to transfer it to the Supreme Electoral Tribunal, which is the in charge of the elections.

"It seems to me that in the matter of suffrage security, no precaution can be dismissed and that a complaint such as the one we have received must be treated carefully without disqualifying any a priori official or institution," said the legislator.

The Commission on Income and Public Expenditure also approved a motion to ask the center for information on what has been spent in the surveys, who is responsible for it, and the methodology and technical support used.

The director of the center, Felipe Alpízar, said that the complaint does not reflect reality and that it contains falsehoods.

"The complaint does not fit the reality and is full of inaccuracies and falsehoods and when the survey is published it will be clearer," said Alpízar, stating that center staffers are very certain about the work they have done and that, in addition, the procedures and data are always available and open to those who want to review it.

The survey published by this center will be the last one that will be released before the second electoral runoff round.


The poll sparked some controversy at the legislature after a group of citizen's said the results were manipulated.

Libertarian leader Otto Guevara
office's raided by attorney general

Emilia Navas, prosecutor general of the republic, led a raid Friday morning at the offices of the Specialized Legal Group, linked to the libertarian lawmaker Otto Guevara.

The raid was made in search of evidence for an investigation into the deputy and former presidential candidate.

The operation was led by the prosecutor general and agents searched for electronic evidence and documentation that could be used as part of an investigation against the lawmaker, the Attorney General’s Office said.

The Office of the Prosecutor also stated that the possible crime of falsehood is being investigated in an affidavit before the Office of the Comptroller General of the Republic.

The investigation is grouped under file 18-000040-033-PE and refers to statements that Guevara submitted to the Office of the Comptroller General between May 2014 and 2017.

He allegedly omitted assets owned under his name, as well as participation in a corporation, the prosecutor said in a statement.

As Guevara occupies a legislative position, prosecutor Navas was present in the raid carried out in Los Yose de Montes de Oca, San José.

Guevara is accused of not filing accurate information of his assets at the comptroller's office.

While the raids were being carried out, the legislator was working in the Bank Credits Legislative Committee.


Health services will work as usual this week

During this Holy Week, services of the hospitals and clinics of the Costa Rican Social Security Fund  will operate normally.

According to the institution, the administrative and financial services will continue during three days of the Holy Week, Monday through Wednesday, with the exception of the central office platforms that will remain closed throughout the week.

The management body of the institution will work during regular hours on Monday, Tuesday and Wednesday.

Hospitals, health areas, specialized units and production are supposed to insure continuity in the provision of services, and the necessary staff is supposed to be available and comply with the set schedules.

Other staff members will be granted vacation Monday through Wednesday because they do not provide services directly to patients.

Thursday and Friday constitute mandatory holidays, so those staff members who must provide patient care and other necessary services will be paid according to what is established in the institutional regulations.

The Social Security Fund, known as the Caja, requested that medical directors establish the schedule of activities for Holy Thursday and Friday as appropriate in order to guarantee continuity and timeliness in the delivery of services to patients.

Rainy season will settle in between April and May, meteorologist say

The National Metrological Institute announced that the transition to the rainy season will be felt in the months of April and May throughout the country.

The director of the institute, Juan Carlos Fallas, explained that the arrival of rainfall is expected on the dates that are customary under normal conditions.

He pointed out that there will be alternation in the beginning of the rains. The authorities predict that, as of the first week of April, the rains will reach the South Pacific.

For the last week of April, the rain will spread through the Central and South Pacific. For the rest of the country, the projection is for the rain to arrive throughout the second week of May.

Among the most striking aspects of the national projection is a slight decrease in the distribution of rainfall between July and September in the Pacific and the Central Valley.

Similarly, by the end of the year (October to December) there could be a significant decrease in the Pacific and the Central Valley, but an increase in the Caribbean.

It is expected that by the middle of the year more details will be known.

The director of the National Commission of Emergencies, Iván Brenes, pointed out that Costa Rica has a high exposure to natural phenomena, so citizens should always be attentive.

Less rain is expected this year, according to the scientist.


"The CNE deploys actions of constant preparation with the lessons we have learned after dealing with impacts such as droughts, floods, Hurricane Otto and Storm Nate," Brenes said, using the Spanish acronym for the commission.

On the other hand, the institute noted that for 2018 a decrease in the number of hurricanes and cyclones is expected.

Electronic invoicing will be mandatory
for all taxpayers as of November

All taxpayers must move to electronic invoicing by November 2018, according to the General Directorate of Taxation of the Ministry of Finance. The decision was published in the national newspaper La Gaceta as resolution number DGT-R-012-2018 in which the status of the system was reported.

According to the document, taxpayers must start with the implementation of electronic invoicing according to the last digit of the identity card number in the case of people or the the last digit of the identity card for a legal entity.

Taxpayers whose ID ends in 1, 2 or 3 must start with the system Sept. 1. Those with identifications ending in  4, 5 or 6 must do so starting Oct. 1. Those with ID numbers ending in 7, 8, 9 or 0 must begin Nov. 1.

The obligation also applies to the large taxpayers of the country, who previously had been notified individually.

Taxpayers under the simplified tax regime are exempt from the system, as provided by the Income Tax Law and the General Sales Tax Law. This also applies to state universities, the National Apprenticeship Institute, the Costa Rican Social Security Fund, the National Road Council, the Social Protection Board, the National Production Council, the solidarist associations, the financial entities, the Central Bank of Costa Rica, the ministries of the executive branch, the Legislative Assembly, the Supreme Electoral Tribunal and the Supreme Court of Justice.

A resolution of September 2017 established mandatory electronic invoice in the health, accounting and legal sectors. Additionally, it demands the same from contributors  in the fields of engineering, architecture and information technology that must be incorporated by April 2, while in May it corresponds to geologists, geographers, biologists, publicists, among others.

The Code of Tax Rules and Procedures establishes sanctions for not using official vouchers as part of Article 85. Sanctions include two base salaries and, in case of recidivism, the closing of the business.

Some public institutions are exempt from the tax measure.


In addition, the person could be fined with the equivalent of 2 percent of the undeclared gross income, up to a maximum of 100 base salaries (¢43,100,000).

"The main objective of the implementation of the electronic invoice is to provide the tax administration with greater sales tax control tools. For this reason, programs are being prepared that will allow us to review compliance with this obligation in order to apply the sanctions that correspond but above all to improve voluntary compliance," said the director of Taxation, Carlos Vargas.

Dropouts reach its lowest point in a decade

Student dropouts in preschool, primary and secondary day and night presented for 2017 has shown the largest decrease in the last 10 years, as indicated by the Ministry of Public Education.

According to the Department of Statistical Analysis of the ministry, last year a decrease in the national exclusion index of 0.9 percent was reported, that is, it went from 4 percent in 2016 to 3.1 percent in 2017. This means that 8,157 more students stayed in the classrooms.

For the first time since the ministry has a record a negative rate was reported at the preschool level. This means that more students finished an educational level than those who started. In this way, it went from 1.7 percent in 2016 to -0.3 percent in 2017.

For the minister of Education, Sonia Marta Mora, "this is due to the strategy of early childhood education that we started in the Ministry of Public Education" which aimed to identify children who were out of the classroom and insert them in preschool to have more opportunities.

During 2017, 324 more children attended preschool.

The secondary exclusion also obtained important numbers, since it went from 8.4 percent to 7.2 percent, maintaining 4,524 more young people than in 2016, while in primary education the exclusion decreased from 1.0 percent to 0.7 percent, which indicates that 1,398 children remained in the classrooms.

Mora also emphasized the fact that the strategy also increased the permanence, reintegration and educational success of the students.

There are 160 specially targeted schools that showed a 3.7 percent drop in dropouts. The minister said that this is a very important figure because those schools are in priority attention sites, that is to say there are unsatisfied basic needs, low level of education in homes, high drops out and similar problems.

For the year 2015, those schools registered a dropout of 14 percent while in 2017, it only reached 10.3 percent

From 2014 to date, the ministry has shown that 17,021 more students remained within the education system.

According to the Ministry of Public Education, students’ retention should be focused on the authorities and not the students themselves.


On the other hand, the project to support secondary education for the reduction of student dropouts, Proeduca, achieved a reduction of 3.7 percent in the 80 institutions where it operates.

According to the education minister, the great decrease in school dropouts is due to priorities and a change of focus.

"In the first place, we defined . . . the fight against school exclusion as a priority line. In addition, there was a change of focus because before it was spoken of as desertion and now of exclusion. That is to say, it is on the educational side that the challenge of retaining or reinserting the children is and it is not on the students' part," said the minister.

Mora said the cooperation of the regional offices, the opening of canteens, providing transportation, scholarships and childcare were also factors that contributed to the success in reducing the exclusion.

Airport police detains two people with pending arrest warrants

The patrols developed by the officers of the airport police as part of the Directorate of the Air Surveillance Service of the Ministry of Public Security managed to identify and detain two subjects who had accounts pending with the department of justice.

In Alajuela in the vicinity of the Juan Santamaría International Airport, the members of the airport police found a person named García, a 21-year-old Costa Rican national. He was arrested on a warrant and referred to prison on an allegation of aggravated robbery.

Meanwhile, the airport police located a 52-year-old man named Mena and held him on a warrant alleging fraud and the use of false documents. The suspect was arrested near the Tobías Bolaños Airport in Pavas and was transferred to the First Judicial Circuit of San José.

Thursday night, airport officials found a drug load that apparently was ready to be illegally sold. It was 213 doses of crack and 10 doses of marijuana. The drugs were located after a patrol investigated a community known as La California in Alajuela.

Gardening Vignettes

My hair has gotten a bit shaggy over the last few months, so I decided to head into town for a haircut from a lovely lady whose shop is behind the local restaurant where her husband works. He came out to tell me that this was her morning off – darn it. As I was leaving through their small garden, I asked him about a shrub. “Café,” he said. Then he pointed to the ground around the shrub and added, “Baby coffee.”

Well, I couldn’t help but ask if I could have some of the babies. Grinning, he pulled some out and handed them over.
“Only you,” said Metric Man with a chuckle, “could go in for a haircut – not get one - and come out with coffee plants.”

Since I am forbidden to work in the garden, I decided to get out my Dremel. What does a Dremel have to do with it?
We get a lot of visitors, usually people who want to see the orchid gardens, and walking sticks are a great help on uneven ground. This is especially true when that ground is wet (happens occasionally) so my right-hand-man, Armando, keeps an eye out for appropriate branches to use as walking sticks. Well, since I can’t garden, I thought I would get out the Dremel and cut vine-like tracks into them, paint the tracks and then paint leaves and flowers on them.
Looking back, I can’t think of why this would be possible. In first grade, I was the kid who couldn’t color inside the lines of a coloring book (I still can’t).

Gardening is a great way to get fit and maintain your weight (maybe even lose a pound or two). This sprang to mind this morning when I went into my dresser for a pair of shorts to wear around the house. Usually, I grab a pair of designated gardening shorts. You know the ones I mean – the ones with grass and mud stains that won’t come out. The ones with spots of paint from the time you painted the garden fence, but not today. Today we may have people stop by, so my shorts have to – at least – look clean.

And there they were, my comfy old blue shorts. I stopped and thought back… Yes, I remember buying them. It was sometime around 1992 or ‘93 and I was gardening up near West Point, NY. They were my good shorts for hanging out or going shopping. They are a bit faded, but unspotted. And they still fit! Twenty-six years old, and they still fit. Must be all that hard work in the garden, so get out there and get going!

Gardening is healthy!

Here we are in spring and the Resurrection flowers are in bloom. We have a number of flowers with this name, usually flowers that, like this one, put out a flower before they put out leaves (the exception is the Resurrection orchid). These flowers make a wonderful display when planted in a large grouping, but be careful, because they disappear completely – leaves and all - later in the season. Plant in full sun and mark them so you don’t forget where they are.
