Legislature approves on first vote plan to allow trawling

The full legislature approved a draft that seeks to reactivate licenses for legal shrimp trawling with 35 votes in favor and seven against.

The draft has been under discussion since 2013, and it has sparked controversy among the legislative factions and the government branches that disagree with the technical criteria.

The bill, No. 18.968, supposedly seeks to regulate shrimp fishing in order to protect the marine resource and prevent its exploitation, but it allows fishing licenses to be renewed for the extraction, not only of shrimp, but also of Chilean shrimp, sardines, tuna and other species.

According to the legislative bill, shrimp trawl nets can be used as long as they have a special device that excludes the capture of other species of fish and turtles.

This proposal has been publicly rejected by the guild of artisanal fishermen and by at least 15 environmental organizations in Costa Rica, who argue that there are scientific studies that show that trawling is not sustainable.  However, the measure was supported by the majority of the lawmakers.

The project passed its first debate in Congress after the pressure exerted by families who depend upon shrimp fishing for their livelihoods.

The prohibition was based on a ruling by the Constitutional Chamber of the Supreme Court, which declared this type of fishing practice as a risk for the Costa Rican marine ecosystem.

Last week, the chamber also voided an agreement, issued of the Costa Rican Institute of Fishing and Aquaculture, which sought to reactivate the trawl fishery.

The Supreme Court has said this practice should be regulated exclusively by law, which is the reason why the legislature was urged to issue a measure on the subject as soon as possible.

According to the magistrates and several legislators who oppose this practice, there are multiple studies that confirm that more than 70 percent of species caught with trawling methods are not shrimp but marine animals that were trapped by accident when they were near the nets.

According to the last constitutional criterion of the court, trawling violates at least six articles of the Constitution, among them, the right to a healthy and ecologically balanced environment, the country's food security and the principle of sustainable development.

The rush to approve the new law comes after an order issued by the Constitutional Chamber of the Supreme Court.

The legislative bill includes three types of fishing licenses that can only be granted to Costa Rican vessels for commercial purposes in the Pacific Ocean.

These are the categories:

Category A: (licenses for coastal shrimp fishing) Vessels with licenses or fishing permits for shrimp that use fishing nets as trawls in the bottom may capture shrimp resources as target fisheries only on the Pacific coast, provided that they are not prohibited areas, areas of total protection, and with special regulations or restricted during times and closed areas.

Category B: (license for deep-sea shrimp fishing) Boats with fishing licenses or permits for the capture of deep sea shrimp species by using bottom trawling nets only on the Pacific coast.

Category C: (license for small-scale vessels) Permit holders with a fishing license or permit with small-scale artisanal vessels, authorized only to catch shrimp with legally permitted gill nets, according to the measures, sizes and technical conditions established by the executing authority and incorporated in the respective fishing licenses.

A Danish flagged vessel was spotted March 15 in the vicinity of Cocos Island which caused park rangers to issue an alert, said the National System of Conservation Areas in a press statement released yesterday.

The vessel was spotted by the new radar installed in the national park.

Geiner Golfín, administrator of the area, explained that the Danish ship was seven nautical miles from the mainland. He added that this event is recent but tuna fishing vessels, whalers or shrimpers constantly roam the vicinity of the protected area in Cocos Island.

In this case, the Danes explained they were on the site because they were coming from Panama.

"They violated the security perimeter of the park. Fortunately, with the radar and the Faico II boat, we were able to detect the unusual situation," explained Golfín. "That boat could have been doing illegal fishing, but fortunately, nothing happened."

The European vessel had a ramp like that of a whaling ship with greater trawling capacity than a shrimp trawler and the crew used large nets like those of a tuna boat, the statement said.

"These boats are going through our exclusive economic zone, and we do not have control. They pass about 50 or 60 miles away from the island along with boats," Golfín added.

Earlier this month, park rangers in the area found illegal fishing gear with two silky sharks and 30 pig fish inside, just one of many cases of illicit activities detected in the area.

Sharks are one of the most sought-after species around Cocos Island.

Some 532 km away from Cabo Blanco, Puntarenas, the island is a terrestrial and marine ecosystem of 24 square kilometers.

Due to its size, isolation and conservation status, it is a national park and one of the most privileged natural sites in the world.

Its biological diversity caused it to be classified as an ideal natural laboratory for research on the evolution of species and long-term monitoring of the environment.

Immigration authorities will deploy special operations
during Holy Week

The Immigration Directorate of Costa Rica has announced that it will strengthen the immigration control posts as part of its Holy Week operation, which will begin Friday and end April 4.

The immigration police seek to ensure the operations of the institutional service, as well as to facilitate the air and ground traffic of passengers in the most orderly and safe manner, the agency said.

"The actions are focused on maintaining the correct migratory control, national security, detections of human trafficking cases and intercepting people who intend to evade authorized entry and exit posts," said Gisela Yockchen, general director of the directorate.

Among the actions that Costa Rica will implement is strengthening border posts with regional coordination officers and central offices.

A total of 290 officers will participate in this special operation with activities such as immigration control and verification and rejection of people in irregular migratory status.

The authorities will maintain roadblocks and participate in operations in conjunction with the police, the Judicial Investigation Organization, the border police and the traffic police, verifying the immigration status of foreigners.

In addition, they will provide service for the international transport of border departures and entries, in order to give fluidity to the migratory movement in the border post of Peñas Blancas, the agency said.

Yockchen explained that roadside devices will be used to control migrant flows in irregular conditions at strategic points such as Liberia (North Pacific), Paso Canoas (border with Panama), San Carlos (north), and Sixaola and Limón (Caribbean).

Official data indicates that during Holy Week in 2017, the authorities accounted for 210,000 migratory movements.

At international airports, the service will be reinforced to meet the increase in the demand for entry and exit of the national territory.

The directorate statement reminded people of the importance of traveling with a valid passport, as well as paying the exit tax.

Trade union prepares war against fiscal reform bill

The National Association of Public Employees, the largest trade union group in Costa Rica, announced Wednesday that its opposes the tax reform bill. The union coalition states that its members believe the measure will affect the working class and asked for a dialogue channel to be opened.

The Bill for the Strengthening of Public Finances, "is totally inappropriate. It is extremely unfair. It will bring more poverty and inequality, and it will not solve the seriousness of the current fiscal problem," the association said in a statement.

The union coalition said that the great problem of the country's finances is the payment of interest on the debt, which according to its calculations totals to 4 percent of the gross domestic product.

In 2017, Costa Rica's fiscal deficit closed at 6.2 percent of gross domestic product and total debt at 48 percent, according to official figures.

The bill that the legislature is discussing would generate new resources of about 2 percent of gross domestic product and promote the conversion of the 13 per cent sales tax into one of added value at the same percentage. The revised tax also would include more products and services.

The legislative bill also seeks to reform the income tax to cover capital gains, add a fiscal rule to control spending and establish public employment initiatives that seek to reduce salary bonuses and grant others only for good performance, without affecting rights acquired by workers.

The National Association of Public Employees said that the discussion has focused on pointing out the salaries of the public sector as responsible for the fiscal deficit and that the issue of interest on the debt has not been discussed.

"The political class, the two presidential candidates, the social and union sectors, the business sector, the academy, we all have to sit down, as a country, to talk about this issue," the union said.

The association added that, "the working class is not responsible for this catastrophic fiscal reality. Public employment salaries are not responsible for this appalling reality, which is the payment of interest on the debt."

The two presidential candidates chosen for the second round electoral runoff April 1, Fabricio Alvarado and Carlos Alvarado, have been in favor of the fiscal reform.

This initiative is being discussed by a legislative commission, but has been attacked by appeals from legislators who oppose it, which has delayed its process.

According to calculations made by legislators, it will be very difficult for the law to be approved before May 8, the date on which the new president of Costa Rica will assume power, replacing  Luis Guillermo Solís.

Sixaola bridge will be ready in May 2019, president says

The bridge over the Sixaola River that will connect Costa Rica with Panama will be ready by May 2019.

This was announced Wednesday afternoon by President Luis Guillermo Solís Rivera at a press conference following a meeting he held with his Panamanian counterpart, Juan Carlos Varela Rodríguez.

"I think, I hope not to be mistaken, it is a term of one year that the builders have. It seems to me that it is a year to finish the construction," said Solís.

However, Solís stressed that the date is only an estimate, since the project is a major work that requires a series of special coordinations due to its binational condition, which includes obtaining work and migratory permits from both countries, in addition to the transfer of materials and equipment both national and foreign.

"This procedure has to do not only with the location but with all the regulations on both sides of the bridge, complying with labor regulations, immigration, everything that has to do with equipment, materials that have to pass from one place to another. Due to its binational nature its construction has to respect the regulations of both countries," he said.


The structure has a cost of $15 million, and it was approved last February.

Solís explained that the work includes the dismantling of an old railway bridge, whose structure will be donated to the Municipality of Talamanca. This process, according to the Solís, is 70 percent done.


Within the additional 30 percent is the conservation of the bases of the previous platform, which will serve as support for the construction work of the binational bridge.

At the moment, a provisional bailey structure is at the location. Another aspect that should be modified is the location of the customs facilities of both countries.

"The bridge is a fundamental part of a tourist corridor that has been, for all intents and purposes, developed between the southern Caribbean of Costa Rica and the eastern Caribbean of Panama, and this means that the work, once built, will allow transportation very easily," Solis said.

Independent workers owe $342.8 million
to the Social Security Fund

As of February, independent workers owe the Costa Rican Social Security Fund around $342.8 million.

According to the data of the collection office of this public institution, compiled through a study conducted on this population, it was determined that 45 percent of the independent workers distributed throughout the country have defaulted.

An independent worker is any person who develops an income-generating activity independently and through which they obtain their income. According to the fund, known as the Caja.

Luis Diego Calderón, director of collections, said that more than 226,000 people are registered as independent before the institution and approximately 90 percent carry out commercial activities while more than 48 percent declare lower income and 60 percent are aged between 40 and 64.

The same study shows delinquency is higher in trade activities. For example this includes small merchants, home sellers and street vendors, whose debt represents 25.5 percent of the total owed.

They are followed by those located in the activity "community, social and personal services" with 17 percent and those dedicated to "various activities" with 12.5 percent.

Calderón said that legally applicable administrative and judicial instruments are also applied to these sectors with the purpose of recovering the debts.

Delinquent independent workers may face fines, interest and surcharges for the judicial collection process.

According to the data, there was a downward variation in the percentage of delinquent independent workers.

Novelist, playwright and theater director
Daniel Gallegos dies at 87

The world of Costa Rican letters and art said goodbye to the playwright, writer and lawyer Daniel Gallegos Troyo, one of the most influential people in Costa Rican culture since the 1960s.

At 87, he leaves behind a brilliant legacy with outstanding works such as “Los profanes” (1960), “Ese algo de Dávalos” (1960), “La Colina” (1968), “La Marquesa y su tiempo” (2014) and even a new surprise that will be published soon, according to those in the arts scene.

"I am fortunate to have known him as a friend in Costa Rica and in the United States, not just a friend, but what is called a well-founded friendship," said writer Alfonso Chase. "I always thanked him for his kindness and was a really superior man because he had had a very good education."

Gallegos is considered one of the main proponents of the Costa Rican theater. He fell in love with this art in New York, where he studied with the main directors at the time and then traveled to other countries.

Then he returned to the country to develop all its teachings.

He was director of the University Theater between 1963 and 1979, a transcendental time for the development of the theater activity in Costa Rica, in which he achieved a decisive participation and was the founder and then director of the School of Performing Arts of the University of Costa Rica.

"The irruption of Daniel Gallegos in the Costa Rican theater changed everything. He had lived in New York. He had been a friend of Jane Fonda. He had studied at the Actors Studio, which is the leading academy of theatrical art in the world, and had come with that totally renewed world that is expressed in his initial works," said the writer, Carlos Cortés.

His great dexterity earned him many prizes along the way such as the Magón National Culture, for his theatrical production, his narrative and his contributions to Costa Rican culture and art in 1998.

He was also the winner of the Aquileo J. Echeverría National Award in 1994 for one of his novels.

"For me, he is the best modern playwright in Costa Rica and Central America," Chase said.

Among his legacies, Daniel Gallegos left a new book that will come to light very soon, announced the director at Uruk Editores, S.A., Óscar Castillo.

The work is called “Conrad,” the name of a main character, who is a Costa Rican who goes to the U.S. to study, earns great success and mingles with important friends of Hollywood. After many years the character returns to Costa Rica and questions the life of luxury.

Brother of former minister Luis Fishman dies in kayak accident

Wednesday Marvin Fishman, an experienced kayaker, disappeared around noon, and his body was discovered in the afternoon. The accident occurred at Playa Maderos in Nandayure, Guanacaste.

According to the Red Cross, staffers carried out searches to find the man, who was the brother of the ex-legislator and former security minister Luis Fishman.

Apparently, the missing man came to a restaurant in the area where he left his vehicle. The owner of the restaurant said Fishman said would go out kayaking and then return to lunch.

However, Fishman never returned, and only the small boat and the oar appeared. According to the Red Cross, when the boat appeared the merchant became concerned and notified authorities.

After an intense search by sea and land, Coastguard officers at Puerto Coyote and fishermen of the area managed to find the body.

The body was found a mile and a half away from Bejuco beach. Fishman was not wearing a life jacket at the time of the discovery.

The event was reported from San Miguel Beach in Bejuco de Nandayure, Guanacaste.


The body was transferred to the Coast Guard Station of Puerto Coyote to await a prosecutor to arrive to carry out the proper procedures.

Public buses must provide transportation
on Holy Thursday and Good Friday

The public bus services cannot be suspended during Holy Thursday and Good Friday this coming Holy Week. The dates are March 29 and 30.

However, companies can implement measures such as the reduction of units and schedule adjustments, depending on the demand that occurs during the week, according to the Public Transportation Council.

The planning for the holy days must be communicated to the council and to the users before the dates in question, the regulatory agency said.

According to the person in charge of technical management of the council, Aura Álvarez, users who detect irregularities in the service may report it.

Álvarez also emphasizes that, from Monday through Wednesday next week, there should be no changes. However, many companies will implement the schedules they usually apply on weekends.

The council sent the reminder to the companies on March 8, in order to guarantee the service on all regular routes so that users do not have any problem with this type of public transport.
