Murderer of five college students
sentenced to 216 years in prison

On Tuesday, a man identified as Gerardo Ríos Mairena, accused of slicing the throats of five university students and seriously injuring a minor one year ago was sentenced to 216 years in prison.

The Criminal Court of Liberia, in the province of Guanacaste (North Pacific), issued the sentence imposing the maximum sentence of 35 years in prison for each of the five counts of murder, 35 years for attempted murder and six years in prison for the crime of sexual abuse.

"It is a total of 216 years of prison that, according to the law will become 50 years in prison," said judge Guillermo Arce Arias, who was responsible for detailing the evidence that resulted in the sentence delivered yesterday.

The events occurred on January 19, 2017, in the city of Liberia, when apparently Mairena, then 34 years old, entered the house where the victims were, tied them and attacked them with a knife.

The victims were identified as Joseph Briones, 22; Dayana Martínez Romero, 24; Stephanie Hernández García, 25; Ariel Vargas Condega, 24, and Angie Serrano Mendoza, 24. A 14-year-old minor survived a wound in the trachea.

Judge Arce said that the sentence was issued when the court was certain that Ríos Mairena was responsible for the crime.

The judges analyzed 27 statements of witnesses and experts, as well as 70 documents, mostly police reports, checked the photographs of the scene and analyzed the videos, to reach the conclusion that Mairena was guilty.

Part of the evidence that convinced the court of his guilt was the testimony of the minor, who identified him in a directly and who had also said that the man had a tattoo on his back, on the right side, with Chinese letters in blue.

"An analysis of calls that place you and your phone on the scene that morning the existence of a blood trail in the room where the homicides were carried out, where six people suffered the attack, the aggression, in that room appeared your fingerprints, all those elements head the evidence towards yourself," said Arce.

The defendant, who has a history of drug trafficking, was a neighbor of the students and a family member of the person who rented the house for them.

"You were enjoying a benefit. The justice system trusted you, it gave you an opportunity to behave according to the rules by keeping yourself free and you paid back that confidence that the country put in you, through its system of justice, ending the lives of five people and trying to end the life of one more," said Arce.

The prosecutors raided the suspect's house a few days after the crime and found evidence that allowed his arrest. Since then he has been in preventive detention.

This is one of the most talked about cases in the recent history of Costa Rica.


Today is the last day to pay the corporate tax

In accordance with the new Law 9428, this obligation must be paid by all commercial companies, as well as any branch of a foreign company or its representative and individual companies of limited liability that are registered or that from now on are registered in the Registry of Legal Persons of the National Registry.

To calculate it, the current base salary for the year 2018, which accounts for the amount of ¢431,000 is taken into consideration.

Said payment can be made in any bank, and its collection will happen if the company is up to date with the income tax, otherwise, representatives should go Tax Administration to regularize that situation.

90% of the money collected goes to the Ministry of Public Security and the remaining 10% to the Ministry of Justice and Peace.

If the payment is not met on time, the National Registry will not issue certifications and the inscription of documents of the delinquent entity cannot be done. Companies behind their payments cannot have contracts with the State

The delay or omission of this tax also has the following economic and legal consequences:

Collection of interest in accordance with Article 57 of the Code of Tax Rules and Procedures (CNPT), at a current rate of 12.80% per year.

The National Registry will cancel the presentation of any document submitted by a delinquent taxpayer.

The debts derived from this tax will constitute preferential legal mortgage or preferential pledge, over real estate or other assets owned by the delinquent companies or their representative.

The non-payment of the tax established in this law for three consecutive periods will cause the dissolution of the company.

The legal representatives of the legal entities will be liable for the non-payment of the tax.

The only companies that are exempt from paying the tax are those registered as small and medium enterprises (
PYMEs) before the Ministry of Commerce.

The Supreme Electoral Tribunal will complete the delivery of electoral material Thursday in indigenous areas and some other places of difficult access four days before the presidential elections.

The Electoral Registry Director of the TSE, Héctor Fernández, explained that this week authorities will define the parts of the country where there will be changes in the electoral venue for some reason or another.

Fernandez said the delivery process will be completed and the infrastructure will be ready to receive the voters.

In this electoral process, 112 electoral advisers, 408 people in charge of voting centers and 3,000 electoral guides will participate.

Fernandez stressed that advertisements and billboards that are already in place will be allowed to remain in view without penalty. There is a ban on new placements immediately preceeding the election.

For this election, 3,673 polling stations will be set up countrywide.


Tougher border control is required,
presidential candidate says

Sergio Mena, the candidate of the New Generation Party (PNG), says the country needs more international cooperation and border surveillance, which should be increased with more support from friendly countries, better human resources, scanners, drones flying the entire border and more surveillance in the oceans.

Mena also emphasized that fighting social inequality is key to reducing crime. He said that he believes in second chances for people who commit crimes and wants prisoners to obtain training and rehabilitation.

In 2017, there were 604 homicides, 26 more than in 2016. Last year was the most violent year in Costa Rican history and 2018 started even more violently. January has accumulated a high quota of violent deaths, according to data from the Judicial Power.

Inequality and school dropout are part of the causes that impel young people to join organized crime. Nationally, 74% of the victims of homicides are between 18 and 39 years old, that is to say, they belong to people of productive age in the country. That is why an integral solution is necessary, explained Mena.

Wild life management remains unclear for tourism chambers

The Ministry of Environment and Energy (MINAE) has failed to develop protocols for wildlife management sites, according to the National Chamber of Tourism (Canatur).

According to the Chamber, different organizations affected by the Wildlife Conservation Law Regulation (LCVS) have expressed concern that they have not yet been summoned by MINAE to participate in the process of preparing the protocols that must be fulfilled by the wildlife management sites.

In mid-January 2017, groups of biologists and various sectors involved in the management of wildlife held a meeting with the Deputy Minister of Environment, Patricia Madrigal, advisors and other officials.

On that occasion, Madrigal committed to creating participatory work tables so the different groups involved could work together in the design of the protocols.

On February 9, the deadline for the program expires, the table is still not convened, and there is no knowledge of the process and of the people who are preparing these documents.

"For Canatur, it is important to take into account the technical criteria and needs of the tourism sector, as well as the recommendations of biologists and experts in the field, and this can only be done through an effective participation in the process, which avoids later problems in the application of the regulations as happens when the parties involved are not taken into account,” said the president of Canatur, Isabel Vargas.

Businesses in the tourism sector demand clearer guidelines for working with wildlife.

On January 24, the Vita Ex Situ Association sent a letter on behalf of all interested parties to the Deputy Minister of Environment asking when the protocol meetings would take place, but there has been no response, explained Canatur.

The protocols define procedures that must be followed when running wildlife management sites.

Sixty nine medical specialists will strengthen
the social health system

There are sixty nine new staff spaces in different  hospitals nationwide for health professionals  who have to perform their mandatory social service.

These specialists, trained in our country, are part of the first draw of the year for the Social Service, which is the final requirement to join the Board of Physicians and be able to practice the profession.

The obligatory social service requirement was created between 2011 and 2012, as an initiative of the Board of Physicians and Medical Unions. Its objective is to have new professionals go to areas where the health system needs new staff members helping to ensure that Costa Ricans receive timely attention. The service is performed by physicians in their first year as specialists,

Andres Castillo, president of the board, said that this new infusion of professionals will help solve problems such as long waiting lists.

Of the 69 openings, 54 professionals will be distributed among 15 hospitals, nine specialists for six health areas and six specialists between two Comprehensive Health Care Centers (CAIS).

They will be professionals from 20 different specialties: Gynecology and Obstetrics (13 spaces), Pediatrics (9),  Geriatrics and Gerontology (6), Radiology and Medical Images (6), Neonatology (4), Medicine of Emergencies (3), Physical Medicine and Rehabilitation (3), Palliative Medicine (3), Ophthalmology (3), Otolaryngology (3), Pathology (2), Cardiology (2), General Surgery (2), Endocrinology (2), Gastroenterology (2), Family and Community Medicine (2), Internal Medicine (1), Nephrology (1), Urology (1), and Peripheral Vascular (1).

Penal law "for dummies" published by Poder Judicial

With the aim of facilitating an understanding of the criminal process, the Public Ministry launched the first manual for communicators and non-professionals in law.

The document is called "Manual for journalists and other non-lawyers: 81 practical terms to understand the criminal process in non-legal language,” and was presented on Monday by the Attorney General.

The document, of 33 pages, was prepared by Tatiana Vargas, head of the press office of the Public Ministry; Fernando Arguedas Rojas, deputy prosecutor of Alajuela and Mayra Campos, current Assistant Attorney General and Assistant Prosecutor Training and Supervision Unit of the Public Prosecutor's Office (UCS).

"It is an essential tool so that, through the work of journalists, citizens can receive clear messages and be informed of the events related to judicial issues," the organization said, through a press release.

The manual aims to clarify terms such as 'raids', 'diligence', 'dismissal' and others.

"The work aims to make comprehensible a series of technical terms that are common in the world of prosecutors but need to be transformed into messages that are simple to understand for consumers of media," said Vargas.

Broken pipe caused the cancelation of
35 surgeries at the Heredia Hospital

A broken pipe at the San Vicente de Paul Hospital on Monday morning caused the cancellation of 470 consultations and 35 surgeries. The medical center was left without potable water in less than 15 minutes, so even visits had to be suspended.

Roberto Cervantes, director of the medical center, explained that the problem happened in one of the pipes that deliver the water to the three main buildings.

"We were able to quickly contact the hospital's firefighters, and the Heredia Public Services Company (ESPH). However, the situation could not be resolved immediately, so we were forced to suspend the external consultation in the afternoon," said Cervantes.

The reprogramming of the surgeries started yesterday, so it is expected that they will be rescheduled in one month. Cervantes said that they could even be rescheduled in the next 15 days since the operating rooms are working until 10 pm.

On Tuesday, the visits were allowed again.

According to the hospital service was temporarily restored from yesterday afternoon until this morning, the service was temporarily restored, allowing for normal operation. "Tonight or early morning, the service would be completely restored," explained Cervantes.

More windy days expected the rest of the week

The National Meteorological Institute (IMN) reported the presence of a high-pressure system in the center and south of the United States. This will generate an increase of atmospheric pressure on Central America and the Caribbean Sea, causing stronger winds in the country.

In the first hours of Tuesday, maximum gusts reached 88 km/h in the mountains of Guanacaste and up to 54 km/h in the Central Valley.

The winds will remain between moderate and strong in the country. The greatest gusts will take place in the Central Valley, the Central Pacific, the North Pacific and the mountain ranges, with maximum wind speeds between 50 and 80 km/h.

The IMN also said that rains are expected to be weak to moderate in the Caribbean and the North Zone, especially during the mornings and nights, with an amount of 1 to 30 mm in a time range 6 to 12 hours.

Due to the above, a green alert was established in the following regions:

-North Pacific Region: strong wind.

-Valle Central: strong wind and low temperatures

-Zona Norte: strong wind

-Vertiente Caribe: strong winds

The gusts of wind have been present for almost two months now.


The National Emergency Commission (CNE) issued an advisory, asking that people take precautions in the areas that could be impacted by this alert. The most frequent problems occur when there is damage to roofing and electrical wiring, or when signs, trees, and debris are blown around by the wind.

The CNE also requests the communities and Municipal Emergency Committees be aware of the requirements of the potentially affected residents.
