Legislative bill seeks to toughen punishment
for people who perform abortions

Fabricio Alvarado, evangelical lawmaker from the National Restoration Party, has presented a legislative proposal that seeks to reform four articles of the Costa Rican Criminal Code and create harsher penalties for the crime of abortion. At present, the law establishes a sentence of up to 10 years in prison for the doctor or other person performing an abortion.

"That sanction is unacceptable, because the defense of the fundamental rights of human beings is a duty of this power of the republic," said the Christian lawmaker.

According to the proposal, an abortion without consent of the mother would carry an imprisonment of 20 to 35 years. The same applies if the mother is under 15 years old. The penalty would be from 19 to 33 years if the fetus has not reached six months of intrauterine life.

If the abortion is performed with the consent of the mother, the sentence would go from 18 to 32 years. The penalty changes from 17 to 31 years if the fetus has not reached six months of intrauterine life.

The penalty will be increased if the death of the woman results.

In the case of self-inflicted abortion, the mother would be punished with imprisonment from one to six years. This penalty would be 10 months to five years if the fetus has not reached six months of intrauterine life.

Under the proposed law, abortion would not be punishable if it is done to save the life of the mother and cannot be avoided.

"I propose to equate the crime of abortion with the crime of homicide in our legislation. As for impunity, I propose that it can be claimed only if the life of the mother is in danger," Alvarado said.

Authorities denied access to
Canadian Hell's Angels member

According to the Dirección General de Migración y Extranjería, a Canadian member of the gang “Hells Angels” tried to enter Costa Rica on Jan. 5.

He was denied entry after the plane landed at the Daniel Oduber International Airport in Guanacaste.

Hells Angels is a motorcycle club of American origin and is considered a criminal organization by the Department of Justice of the United States.

Immigration authorities explained the man was denied entry, "due to information linking him to drugs and weapons trade in Canada and the United States."

The police also arrested a Nicaraguan man named López who had been sought by the Costa Rican justice system since 2015 for assault with a weapon.

López tried to enter the country through the border post with Nicaragua at Peñas Blancas when he was caught by officials. He was then transferred to the offices of the Judicial Investigation Organization in Liberia.

Tax on luxury homes is already under collection

The Solidarity Tax for the Strengthening of Housing Programs, or "tax on luxury homes," as it is locally known, is already under collection. It must be paid by the owners of all properties with a value above ¢129 million.

Through Executive Decree No. 40786-H, published in the official gazette La Gaceta, on December 22, 2017, the Ministry of Finance updated and established the new tranches for the tax, which has been in force since January 1, 2018.

The deadline to declare and pay the tax ends next January 15. The solidarity tax falls on the value of real estate for residential use, used on a regular, occasional or recreational basis, including fixed and permanent installations.

Every 3 years, an affidavit should also be presented declaring the updated fiscal value of the real estate. If it exceeds the value recorded by the administration, the new declared value automatically modifies the applicable tax base for the fiscal period in which it is declared.

When the property belongs to several co-owners, they must declare it jointly.

The owner of two or more adjoining or overlapping properties must accumulate them in a single declaration for the purposes of the tax.

In the condominium property system, the declaration of each condominium must include the proportional value that belongs to it outside of the common areas.

In case of transfer of ownership of the real estate, the new owner will be jointly liable for the tax payment of the fiscal period in force at the date of acquisition, as well as the interest.

Those who do not pay by the established dates are subject to fines of up to 150% of the amount of the tax.


The state shows apathy when prosecuting
animal abuse cases, group says

The Association for Animal Welfare warned of inter-institutional slowness for the establishment of sanctions for cases of animal abuse despite the existence of evidence that certifies the abuses.

This was stated by the president of this group, Juan Carlos Peralta, who pointed out that after the approval of the Animal Welfare Law, the processes to establish sanctions are very slow.

The National Animal Health Service receives on average about 250 monthly reports of animal abuse to different species. In accordance with current legislation, sanctions of up to two years in prison can be imposed on anyone who causes the death of an animal.

Peralta explains that, despite this slowness in legal proceedings, people should not stop reporting cases of abuse.

The SENASA maintains the 22-60-83-00 line for complaints of animal abuse.

Death of two homeless males causes a solidarity spree

Different institutions and organizations have come together to provide shelter to homeless people due to the cold front that has affected the country since last week.

Donations have not stopped flowing for those who dependent the Dormitory Center of the Municipality of San José, as well as the centers for those who live in different communities.

On Thursday, January 4, the Commission for Attention to the Homeless of the Central Canton of San José (Comaicsj) was reactivated, in order to assist people living in poverty by providing bathrooms, blankets and clothes. In addition, the hours of entry to the different dormitories was extended.

The morning of that same day, two homeless individuals died in San Juan de Dios Hospital, after arriving with a hypothermia crisis to the San Juan de Dios Hospital. Organizations like Chepe se baña, keeps a "crusade" going to help those who sleep in the streets, offering them a bath, clothes, quilts and implements of basic need.

The Joint Institute of Social Assistance (IMAS) asked the networks in the cantons of the country to activate emergency protocols and coordinate with their local emergency committees in order to channel the needs of the homeless and deliver resources as quickly as possible through the National Emergency Commission (CNE).

Requests are coming from Limón, Turrialba, Tibás, Curridabat and Desamparados. In total, the CNE has been asked for 519 foam mattresses, 811 blankets and 254 meals.

The central canton of San José has different hostels and a dormitory center, run by social welfare organizations, which serve about 1,439 street inhabitants as reported by Imas.

The deceased men who ignited the emergency protocol  ere identified as Alexander Antonio Quesada Calderón, 50, and Luis Alberto Sequeira Espinoza, 45, according to data from the Judicial Investigation Organization.

The National Commission of Emergencies (CNE) said the victims died of hypothermia after being admitted to the San Juan de Dios Hospital. One of them was picked up in Escazú by the Red Cross while the other was near a church in downtown San José.


In the case of Sequeira, his brother, Víctor, arrived at the morgue of San Joaquín de Flores in Heredia, to claim the body.

The family is from Piedades de Santa Ana, according to data from the Civil Registry.

In the case of Quesada, he was a resident of San Rafael Abajo de Desamparados.

Member of both families apologized for not giving more details, but said they feel very affected.

Hospital maternity services continue on halt,

The Costa Rican Social Security Fund (CCSS) has taken a series of measures to minimize the impact of the closure of maternity services at Hospital Calderón Guardia, in San José.

The maternity centers of the Integral Health Care Center (CAIS) of Desamparados and the San Juan de Dios and Women's hospitals were reinforced both with equipment and medical staff.

On December 13, 2017 Calderón Guardia closed the obstetrics and maternity services after detecting the presence of a bacterium known as Serratia liquefaciens.

Maria Eugenia Villalta, medical manager of CCSS, explained that additional budget allocations were approved to pay overtime and cover medical and surgical supplies.

The extension of the maternity closure is due to an order issued by the Ministry of Health on December 26th. It is suggested that it will take an investment close to 100 million colones to refit the closed maternity section of the hospital.

The closure of maternity services has pushed other hospitals to fill in the gaps.


The CAIS Desamparados is currently taking care of 15 daily deliveries, the Las Mujeres hospital went from assisting 11 to 17 and the San Juan de Dios from 15 to 20 daily deliveries.

San Ramón mayor shows concern over rising crime

A man died on Thursday night in San Ramón de Alajuela after a robbery at a liquor store. This and other criminal acts that have been occurring in the area have raised some eyebrows at the local municipality.

According to Nixon Ureña, mayor of San Ramón, similar incidents have been happening for about 6 months.

"We are tired of waiting just like the rest of the people of Ramón," said Ureña.  "We need the central government to take care of this or at least give us the tools or resources to do it ourselves."

Ureña explained they are waiting for more assistance from the Fuerza Pública, not only for San Ramón, but also for neighboring cantons, because violence does not stop.

"We went from two municipal police officers to six, to take care of a population of 100 thousand inhabitants. In addition, we bought a pick-up vehicle so that they do not have to travel only on foot, since distances here are long and this allows them to cover a larger area, we need the Fuerza Pùblica to be in charge of other things in the different sectors," he said.

Although the reasons for the increase in crime are not defined, the issue has been discussed with a team from the Office of the Prosecutor, Public Force, Traffic Police, Ministry of Health, Municipal Police and the Judicial Investigation Organization.

The rise in crime in San Ramón de Alajuela concerns the Mayor, who requests further assistance from Fuerza Pública.


"This is a commission in which we are looking at each of the possible causes of these cases. In some situations it was confrontations between groups, others were assaults. There was also the dismantling of a criminal band where the arrest of its members was achieved," he said.

According to the mayor, two months ago they met with Gustavo Mata, Minister of Public Security, where they discussed the possibility of a sub-direction in the canton.

“Due to the delay, the response they have given us is that they are graduating officers and that there are others who are working on the festivities of San José and Palmares. Therefore, the operation of the address would come after this holiday. This would be a very positive first step," he concluded.

  Chain saw joy!

Oh the joys of a chain saw! The idea that that troublesome branch or tree can be removed in just a few minutes and will trouble you no more. The noise that demands special ear protection. The feel of the motor as it revs and cuts. Watching the tree fall exactly as planned.  All those things that make using a chain saw a true delight.

I used to use a gas chain saw, albeit a small one because using a big one took its toll. Then I switched to an electric saw but the years grew longer. Now I am not allowed to use any chain saw (Metric Man does get to issue orders now and again). True, I have a wonderful gardener to relieve me of onerous duties, but, dang it, I like using a chain say (see above for reasons).

All that brings me to the problem of thinning the trees in the orchid garden and elsewhere, as it seems that even shade loving plants want more sun than they receive right now.  Enter my gardener with my chain saw.

We went out a bit ago and marked the trees to be cut. All of them are small but quite tall and the upper leaves are blocking the sun. You wouldn’t think a skinny tree would be such a problem but jungle and forest trees are on a competition for sunshine. They push their roots deep and sprint upward racing the other seedlings for a spot in the lower canopy. Around them, the losers of the race shrivel and fade away.

And then? The trees that lost the race are processed back into the soil. The rains soak them through and fungi grab the nutrients. Then the ants start to nest under the bark, wresting it away from the trunk. Beetles lay their eggs and the grubs push into the soften wood below the bark. If the tree was a bit hollow, you might find a nest of the stingless bees of Costa Rica busily making honey in their new home. Nothing is wasted. Bacteria swarm through the dead wood. Worms feast on it and deposit their castings to enrich the forest floor. The winner goes on and up and the loser nourishes it. All in a day’s work in the forest.

Speaking of a day’s work, the chain saw noise stopped so I ran out to see what was up (or down).

My gardener was cutting one of the trees with his machete! What fun is that?

With all our work making sure that the orchids have just the right amount of sun and shade, here is one that was blooming on January 4th, and didn’t seem to mind where it was planted. This Costa Rican native is 10cm (4 inches) from tip to tip and my camera angle made the central portion into something unearthly. Could I find its name in any of my books? Not a chance. Possibly an Epidendrum?  How about some help on this one?

American woman tried to bring her
howler monkeys onto Costa Rica

On Thursday, an American woman tried to enter the country at the border point of Paso Canoas along with a baby howler monkey on each shoulder.

The woman, surnamed Frame, came from Panama with a neighborhood permit but without any documentation authorizing her to enter Costa Rican territory with howler monkeys or congos as they are also called locally.

Border police coordinated with officials of the National System of Conservation Areas (SINAC) to take care of the two baby congo monkeys.

SINAC officials confiscated the small animals and took them to a wildlife refuge to feed and care for them. As of now, they still do not feed themselves, nor can they stand on their own.

After the seizure, the woman returned to Panama.
